I had correpondence with a persons who were seeking medical records of ancestors who were committed to this institution in the 1800s. Until now, my schedule has not permitted me to follow through on an attempt, via a declaratory judgment action, for an interpretation of a law the institution is citing to prevent such access.
If any of you have been denied access to records of relatives who died 70 or more years ago and still are interested in obtaining them, please email me at En4cer48@aol.com I think our argument would be strengthened by any cases in which your interest in the record is -- in addition to general genealogical research --a desire to obtain information as to health issues which might be hereditary.
This action would be taken on behalf of the Commonwealth; it will seek only a judicial interpretation of the statute and nothing other than that. In order to frame it, however, I need assistance and information from those who have sought and been denied access to their ancestors' records.
