Salem County Courthouse, Clerk's records; Deed Book E p. 48-49 29 June 1802 Deed: Moses Cook & Wife to John Kyger ; Haines Neck, Mannington Township, Salem Co, NJ Surnames: Cook, James, Kyger, Sharp, Trueland, This Indenture made the twenty ninth day of June in the year of our Lord one Thousand Eight Hundred and two. Between Moses Cook of the Township of Mannington in the County of Salem And State Of New Jersey, Yeoman, and Mary his wife of the one part and John Kyger of the said Township of Mannington in the County of Salem, aforesaid., Yeoman of the other part. Witnesseth that the said Moses Cook for and in consideration of the sum of Eighty Dollars current specie money to him the said Moses Cook in hand by the said John Kyger wall and truly paid or secured to be paid at or before the sealing and Delivery of these Presents the receipt whereof the said Moses Cook doth hereby Acknowledge and --,and these from and from every part and parcel thereof doth acquit , release, exonerate and finally discharge the said John Kyger, his Heirs and Executors and Administrators and every of them by these presents HATH Granted, Bargained and Sold, Aliened, Conveyed and Confirmed and by these presents DOTH Grant, Bargain and Sell, Alien, Convey and Confirm unto the said John Kyger his Heirs and assigns forever A Certain Lot or piece of Land which is situate in Haine's neck in t he Township of Mannington aforesaid and is butted and bounded as followeth; VIZ; Beginning at a stake or Stone for a Corner in the line of lands of Daniel Cook dec'd being formerly called Sharp's line of the road leading to Cook's landing and is a corner of a lot of land of Samuel Laurence James and runs from thence in the line of the said landing road or Sharps line South three degrees East, nineteen rods or perches to the line or corner of a lot of land of Henry Kyger, thence in the line of the same North Eighty eight Degrees East to Spring branch or lands of s'd Henry Kyger, thence in the line of the same or down said branch to another corner of the said Samuel Laurence Jame's lot of land above mentioned, thence in the lie of the same North Eighty nine degrees and thirty minutes West to the aforesaid Stake or Stone as the place of beginning Containing Six acres and one half of land be the same more or less ( which said lot of Land above granted he the said Moses Cook became seized thereof in his Demense as of fee by force and virtue of the last will and Testament of his father Adam Cook, deceased, and of whose real estate division and Partition was regularly made agreeably to law by certain Commissioners appointed by eh Orphan's Court for the County of Salem and in the return of said division of said deceased's real estate by said Commissioners to the Orphan's Court of June term Anno Domini 1797 the above said lot of land is mentioned and set forth in said return in Map E lot No. 4 and therein assigned set off to him the said Moses Cook, his Heiress and assigns in Severally as by said return which is upon record in the Surrogates Office for the said County of Salem reference thereunto being had may more fully and at large appear) TOGETHER with all and singular the Rights, Liberties, Privileges, Hereditaments and appurtenances whatsoever to the said lot or Piece of Land above granted belonging and in anywise thereunto appertaining and the reversion and reversions, Remainder and remainders, Rents, Issues and Profits thereof ___ AND also All the Estate, Right, Title, Interest, Use, Possession, Property, Challenge, Claim and Demand whatsoever in Law Equity or otherwise of them the said Moses Cook and Mary his wife of, in and unto the said Lot or Piece of land and Premises above Granted with Hereditaments and of , in and unto every part and parcel thereof with the appurtenances TO have and TO hold All and singular the said lot or piece of land , Premises and Hereditaments above Granted and every part and parcel thereof hereby meant, mentioned or intend so to be with the Appurtenances unto the said John Kyger, his Heirs an assigns and unto the only proper Use, Benefit and behoof of him, the said John Kyger, his Heirs and Assigns for ever and to and for no other use Intent or purpose whatsoever AND the said Moses Cook for himself, his Heirs, Executors and Administrators Do Covenant, grant, promise and agree to and with the said John Kyger, his Heirs and assigns in the following manner, that is to say, that he the said Moses Cook and wife now at the time of the sealing and Delivery of these presents are the true lawful and rightful owners of all and singular the said Lot or Piece of Land and Premises above Granted and that they have in themselves full power lawful and good authority to grant, bargain, and sell the same agreeably to the true Intent and meaning of the above deed and further that the said Lot or Piece of Land above granted is now free and clear of and from all manner of former and other Deeds, gifts, grants, mortgage or mortgages, mills, intails, dower or right of dower, Judgment or Judgments, Execution or Executions, encumbrance or encumbrances, matter, cause or thing whatsoever that might in any wise mar, hurt, injure of obstruct the same and lastly the said Moses Cook for himself and his Heirs, the said Lot or piece of land and Premises above Granted and every part and parcel thereof with the appurtenances against himself and his Heirs and against all and every Other Person or persons whomsoever lawfully claiming or to claim any estate or inheritance right, title or interest therein or thereunto by from or under him, them or any or either of them to the said John Kyger his Heirs and assigns shall and will Warrant and by these presents for ever Defend. In Witness whereof the said Moses Cook and Mary his wife have hereunto set their Hands and Seals the Day and Year first above written.
