William Hurt (b. 1613/14) & Margaret __?__ Immigrant to VA

I am descended from William Hurt, immigrant to VA who was married to Margaret __?__. The first record that I can definitely associate with this William Hurt is the following records:

On 4 January 1653/54 John Madeson received a land patent of 600 acres in Gloucester Co., VA on the North side of the Mattapony River, adjacent to Col. Taylor’s Creek and Adam Holland for the transportation of 12 persons to VA, including John Madison (Patent Book 3, page 217). The apparent original or this land patent is located at the Alderman Library at the University of Virginia among the Baylor Collection (Accession No. 2257, Box 2, Legal Papers, 1653-1712). This patent says that it is based on (an order?) at James City on 12 day of March 1651/52. Below the land patent itself are several assignments apparently showing the ownership of this parcel of property. John Maddison and his wife, Mary, assigned the property to Thomas Jones on 24 Feb. 1659 (presumably 1659/60). William Hurt was a witness to this assignment. Thomas Jones assigned the property to William Hurt on 10 May 1660. William Hurt and his wife, Margaret, assigned the property to William Nichalls (sic) on 3 Feb. 1682 (presumably 1682/83).

I understand that a William Hurt is listed as a headright for land patent of 1,250 acres patened to Stephen Hamelin in Charles City County, VA on October 26, 1650 (Patent Book 2, page 266). The speculation is that this William Hurt was the same person as mentioned above.

I am not sure that Margaret was his first and only wife. I assume she was and have no information to suggest the was not. She was definitely his wife in February 1682/83 when William and Margaret Hurt deeded the John Maddison property in New Kent Co., VA to William Nichalls.

There seems to be a concensus that this William Hurt was the sone of Thomas Hurt and Martha Winston of Bristol, Gloucester County, England who is said to have been baptized in All Saints Church on March 7, 1613/14. I am willing to accept this allegation as as working theory. As best I can determine, nobody has any documentary evidence showing that this William Hurt was in VA. Does anybody have any documentation to connect this William Hurt to VA?

The Parish register of All Saints Church, Bristol, Gloucester County, England, lists baptism of three children of Thomas Hurt(e) (wife not mentioned) as follows:

Ralphe Hurt, baptized January 16, 1606/07
Roger Hurt, baptized on May 30, 1609
William Hurte, baptized March 7, 1613/14

The Parish Register of Sandhurst, Gloucester County, England, lists the baptism of Radulph Hurte, son of Thomas Hurte, baptized January 21, 1605/06, died February 19, 1605/06.

There are other children attributed to Thomas Hurt and Martha Winston, but I have not found the original parish register baptism record to support the claims baptism/birth/death dates. Also, of the original baptism records I found, none of them mentioned the mother's (Martha's?) name. I am going to order the parish registers that are available to see what other baptisms/marriages/deaths can be documented.

There are a lot of listing for the marriage of Thomas Hurt and Martha Winston showing that they married on October 29, 1599 at Sandhurst, Gloucester, England. I am accepting the fact that such record exists. I will try and find it myself by viewing the parish register for Sandhurst, Gloucester, England.

I have read the Will of Martha Hurt of the City of Bristol, Gloucester County, England, written on August 12, 1651, proved at Prerogative Court of Canterbury on November 12, 1651. It describes her as a widow, meaning that her husband, Thomas Hurt, predeceased her. It mentions her brother, Giles Winstone of Willington Court and her children: William Hurt, "Citizen and Marchant of London", Thomas Hurt and Ann Hurt. She also mentions her grandson Thomas Hurt, son of Thomas Hurt. Executor named was her daughter, Ann Hurt. She said she wanted to be interred in the Church of All Saints. Witnesses were __?__ Winstone, Henry Flower?, Henry Groin?.

So William Hurt, her son was described as being as Citizen and Merchant of London in 1651. This does raise a question about whether he could be the same William Hurt that was listed as headright on the land patent of Stephen Hamelin in 1650. It is possible, but it would require him to be traveling back and forth from London to VA.

I have found a very interesting records in a records called the Inquisitionf Post Mortem for Gloucestershire. It includes a records of the Inquisition of James Winstone, Gentleman, taken at Gloucester on September 2, 1611. It speaks of James Winston owing two parcel of land. First, "one capital messuage called Willington's Courte, in Sandhurste. It says this consisted of 60 cares of land, 40 dacres of Meadow, 120 acres of pasture and 4 acres of wood." It says that he acquired this parcel by deed ("indenture") dated November 28, 1587 with James Winston of the first part, Philip Williams, Esq., of the second part, and Thomas Spenseley of the third part, that for love and affection toward Gwelthian, wife of James Winston, and his son, Giles Winston and his daughter, Martha Winston, James Winston, Philip Williams, Esq., and Thomas Spenseley agreed that James and Gwelthian Winston would own a life estate in the property and after their decease that the land would go to Giles Winston and his heirs, but if he dies without heirs it goes to the next closest male heirs of James Winston and if ther are no male heirs of James Winston, then the land goes Martha Winston and her heirs and if she dies without heirs, then to the heirs of James Winston.

Second, he owned a messuage of 5 acres of land, 3 acres of meadow and 6 acres of pasture in Sandhurst called "Risbies".

The Inquisition goes on to say that james Winston died on February 4, 1588/89 and that Giles Winston, his son, was then aged 9 years, 7 months and 25 days. It does not say the age of Martha Winston at the time, but clearly she was a minor child also.

The Inquisition also says that Gwelthian was still surviving (on October 11, 1627) at Sandhurst and she has taking all the issues and profits from the two properties from the death of said James Winston until now.

There is a Court of Chancery record of a case of Hurt v. Winston, Moulin and Viney in Gloucester, England, in 1673 held in the National Archives of England at Kew, Court of Chancery, Six Clerks Office, Pleadings before 1714, Whittington. This could related to some type of inheritance dispute between the descendants of Thomas Hurt and Martha Winston. It could involve their son, William Hurt, and, if it does, it could mention where his son William Hurt was living in 1673. It it says Virginia, they there would be proof linking this William Hurt to the William Hurt who immigrated to VA. If it mentions William Hurt, Merchant of London or to be living in Gloucester or elsewhere in England, it would tend to prove that the immigrant to VA was a different William Hurt I am investigating this record now and will post an undate on what, if anything, I find. Has anybody else investigated this record previously. If there is nothing helpful in the reoord, I would prefer to save the cost of ordering the record.
