This may or may not be helpful. This is from the Kansas Historical Quarterly Aug 1950 in an article by Louise Barry, about legal hangings in Kansas. There are two pages in this article that tell about Carl Horne, an ex- soldier aged about 35 who was hanged on 12 Feb 1863. He was tried and hanged for the murder of John Phillip Friend at whose house he had been a boarder."....the Leavenworth Times reported"This is the first time in the history of Kansas that a verdict of murder in the first degree has been given." Later in the article, it says that just before he was hanged, he made a speech in German to his friends and then in English said that he was innocent and sorry that he had ever had anything to do with Catharine Friend, the victim's wife, who wasfound guilty of murder in the second degree and sentenced to 10 years.
