Will of Anna Mariah Williams 3 Jan 1802 In the Name of God, Amen, this being the Last Will and Testament of Anna Mariah Williams, being weak in body, but perfect in mind and memory and calling to mind that it is appointed for all people once to die and after death to judgment, do recommend my soul to God, that gave it me and my body, I leave to the discretion of my executors and friends to be buried in a decent and Christian like manner, and as to my worldly goods, I give and bequeath in manner and form following. First, I give and bequeath to my daughter Mary Elam, one Negro boy named Pleasant, to be at her death at her own dispose with out any claim or right of her husband John Elam, to molest or claim the negro Pleasant. Secondly, I give and Bequeath unto my daughter Sally Terry, wife of William Terry, one Negro girl Lucey, to her and her heirs and assigns for ever. Thirdly, My will and desire is that my daughter Marsey Partman should have the use of Negro girl named Rofe, but if her husband Henry Partman should deprive my daughter Marsey of the said negro girl Rofe to be at the will of my executors, John Terry to take and use or hire as he should think best to be done and pay my daughter Marsey Partman the net proceeds of her labor annually. At the death of my daughter Marsey Partman, the said Rofe and her increase from this present date to be equally divided between the children of my daughter Marsey Partman. Fourthly, I give and bequeath unto my daughter Anna Mariah Terry, one Negro girl named Amey, to her and heirs and assigns forever. Fifthly, I give and bequeath to my granddaughter Elizabeth Terry daughter of John Terry, one bed and furniture, to her and her heirs and assigns for ever. Sixthly, I give and bequeath unto my four grand children, namely Anna Mariah Jones, Ezebell Clement, Stephen Clement and Betsey Roten, one Negro girl named Ester, to be sold at my decease by my executor and the money arising from the sale of the said negro girl, Ester to be equally divided between the above named four grand children, but my will and desire is that the part that is bequeathed to my grand daughter Betsey Roten to be disposed in the hands of my executors and to be applied to the use of the said Betsey Roten as he shall think necessity requires. Seventhly, I give and bequeath unto my two grand sons, namely, William Minter and Joseph Minter, the plantation and tract of land I now live on, which contains one hundred and ten acres to be equally divided between both at my decease, to them and their heirs or assigns forever, and I also give and bequeath to my grand son Joseph Minter one cow and calf, one sow and pigs and two ewes and lambs. Eighthly, My will and desire further, is that all remaining part of my estate not bequeathed, to be sold by my executors and the money arising from the sales to be applied as follows. To wit my executor John Terry to receive sixty dollars for his past services. My four children now living, namely Mary Elam, Sally Terry, Marsey Partman, and Anna Mariah Terry, two thirds of the remainder and my six grand children, namely, Anna Mariah Jones, Ezebell Clement, Stephen Clement, William Minter, Betsey Roten, and Joseph Minter have to the other half of said third part remaining. But my will and desire is the part to be paid to my daughter Mary Elam should be paid to her self and applied as she think proper without being subject to the use or control of her husband John Elam, and likewise my will and intent is that the part to be paid to my grand daughter that continue in the hands of my executors and be applied for the use of my grand daughter Betsey Roten as he shall think necessity requires. And also my desire is that the part to be paid to my daughter Marsey Partman shall be left in the hands of my executors and by him paid as shall think most for her benefit. Ninthly, I complete and appoint my son in law John Terry my sole executor of this my last Will and Testament. Tenthly, I hereby disannul and revoke all former will or wills whatsoever. Given under my hand and seal this third day of February and anno domino 1802, and in the twenty sixth year of America independency.
