Names on DEEDS 1817 and 1819 Fayette County OHIO
I have a general question about a couple of deeds in Fayette County, OHIO, USA.
My question has to do with the fact that Penelope is named in the second deed, but not in the first deed. If David and Penelope were married as of Nov. 22, 1817, would Penelope's name be on the purchase deed?
1. 1817, NOV. 22:DAVID BEARD PURCHASED FROM PETER AND HANNAH EYMAN AND FROM JAMES AND ISABELLA (Waddle) BLAIR, FOR THREE HUNDRED THIRTY FOUR DOLLARS, ONE HUNDRED AND SIXTY SEVEN ACRES FROM HENRY GAINS SURVEY. WITNESSES: HENRY THURMAN AND BENJAMIN HENRIKSEN?
2. 1819, MARCH 15: DAVID AND PENELOPE BEARD TO JOHN BEARD FOR SEVENTY FOUR DOLLARS, EIGHTY-THREE AND A HALF ACRES OF LAND FROM HENRY GAINS SURVEY. WITNESSES: ROBERT WADDLE AND JAMES BLAIR.
I have only seen Penelope's name in one other place: 1820, MARCH 20: FAYETTE MINUTE BOOK A:PAGE 324: LAST WILL AND TESTAMENT OF DAVID BEARD, LATE OF FAYETTE COUNTY OHIO PROVED BY MATTHEW MICHIE ONE OF THE WITNESSES THERETO. PENELOPE BEARD WIDOW OF DAVID BEARD ELECTS TO TAKE UNDER THE STATUTE RATHER THAN THE WILL.
The minute book also mentions David's minor son, Evan, who chooses Walter Yeoman as his guardian. I believe this is the same Evan who was b. Fleming County, KY abt. 1800.
Unfortunately there was a court house fire in the 1860s in Fayette County and the person searching the Archives has been unable to find the actual will or any other evidence that David and Penelope existed.
1826, OCTOBER 2, EVAN BAIRD TO JOHN BAIRD FOR THREE HUNDRED DOLLARS, EIGHTY-THREE AND A HALF ACRES FROM HENRY GAINES SURVEY, WITNESSES MERIT JAMISON AND SAMUEL YEOMAN.
In 1830 there is an Evan Baird on the census in St. Claire, IL.
