It could be that in the state your talking about, just being in an asylum could/would give you a divorce, if it was for sure she would be in for the rest of her life. With that said, and if it did not happen that way, but she would be in for life, then her husband may have tried for a common law marriage to his second wife depending on what state he was in.

What state did all this happen in and when???
