looking for a husband/grandfather

Would an individual during the Civil War have to give names of a spouse or parents/guardian if underage? My grandmother took her maiden name after births of 2 children & we don't have a first or last name of their father. She had to give them up for adoption. We have their adopted names but no information of any kind of their father. Any help would be greatly appreciated.
