Josias Fugate 1757

The internet is truly a marvelous instrument, allowing each and every one of us access to millions of documents right in our homes on our computer screens. Previously we had to travel to court houses, libraries, document storage warehouses and depots all across the United States and the world for that matter. And every day now new documents are added for us to peruse and enjoy.

Unfortunately there is a downside to this massive data release as some carelessly, mistakenly or sloppily report connections that are just not proven. Case in point-if you type "josias fugate" on your search engine you will learn that his father is Peter Fugate; James Fugate husband of Em Lambe; James Fugate son of Em Lambe; or others even, despite the fact that there is "no" document yet discover that proves who Josias' father is.

While this is disheartening, I believe that the building DNA database will solve some of the gaps and connections and I'm sure there are many more documents to be discovered, photos to be found and family bibles yet to be reported.

Meanwhile as I search for information and correct entries for the early Fugates, I've been re-reading Mary Fugate's Fugate Family Newsletters. In Volume XIII May 1991, No. 1, page 15 she reported that Michael Pollack editor of Frederick Findings sent her "Fugate" references found in King George County Court Order Books, which reference Josias Fugate, Francis Martin, John Fugate, Christian and William Thrailkill (Fugate neighbors in Culpeper and Fauquier Counties)and others. Those references provide hints, clues and connections to Josias, the linchpin of the 1700's Fugate.

4 Nov. 1737 On the petition of Josiah Fugate it is ordered that he be freed from paying his county levy. (This is probably our Josias) book 3 page 135

7 March 1739 Fran's Martin, Josiah Fugate, William Flowers and Johnsiah (sic) Fugate or any 3 to appraise the estate of William Stone dec'd. (The Johnsiah could be John or Josiah, Josias' son and of course Fran's Martin is Francis Martin, Josias' supposed father-in-law) book 3 page 220

5 July 1745 Josias Fugate being summoned on evidence by John Haddock ag'st William Pates...sd John to pay him for one day's attendance. book 3 page 455

8 Oct 1748 John Fugate being summoned as evidence by Burton Mullican against Howson & John Hooe and having attended three days on the sd suit it is ordered that sd Burton pay him for same according to law. book 3 page 604

4 Nov 1749 Josiah fugate on a jury panel. book 3 page 648

4 May 1750 James Hewit, Chriss'n Thrailkill, William Thrailkill, John Fugate or any 3 of them to appraise the estate of Richard Porch. (Henry Threldkeld was Martin Fugate's neighbor in Culpeper/Fauquier County) book 3 page 662

4 Dec 1755 "Then the Court proceeded to lay the levy....to John Fugate for timber for a bridge...24." book 2 page 591

15 Dec 1755 Copy of poll taken listed under Col. Charles Carter #158 Francis Fugate. and on another list under Charles Carter Jun Fran' Fugate book 4 page 228

2 June 1757 The last will and testament of Josias dec'd was presented into court by Francis Fugate his executor. Francis Martin Martin bondsman. ( Francis Fugate was Josias's son and Francis Martin his supposed father-in-law.) book 2 page 718

20 Jun 1757 The court proceeded to prick down the several persons hereafter named as Vagrants, to wit: George Carr, John Holmes, John Cannaday, William Pattishall, Thomas Jones, Edward Jones, John Sacry, Moses Rankins, Courtney Tanner, John Rose, John Armstrong, John Fugate, Junr, Patrick Murphy, Richard Underwood, William Morrison, John Riley, James Roark, Edward Stanton & ajames Hill, James Martin. Ordered that the sheriffs Lts., Ensigns, corporals & sergents apprehend the before mentioned persons pricked down as aforesaid..cause them to appear Monday 27 June at 9 o'clock.
27 June 1757 :appeared George Carr: discharged; John Holmns being a servant to Cornelius Tomby, discharged; Edward Jones, Moses Rankins, Courtney Tanner, James Martin are in the service; Patrick Murphy voluntarily enlisted; Wm. Pattishell, Wm. Morrison, John Riley & Richard Underwood are in service; John Rose & John Sacry do not come under the Vaganant Act but are draughted into service; Edward Stanton is unfit for service; John Armstrong, John Fugate Junr, James Hill, James Rork, John Cannaday & Thomas Jones failing to appear are deemed deserters. book 4 page 283

7 May 1761 John Fugate, aged, declared exempt from county, levy. book 3 page 933

7 May 1761 John Fugate on Grand Jury panel. (Interesting that old John was exempt from taxes and on a jury on the same day!) book 3 page 934

March, 1765____Fugate on list to appraise the estate of Jane C___man. (too faded to read) book 3 page 1182

Some of the records that Michael Pollack provided were too faded to read. Hopefully better copies will give us more useful information and maybe within the 1000's of pages in the King George Books there are others entries about neighbors, friends, relatives that could fill some gaps that we all have.

These records do hint that John Fugate (Possibly) Peter's son, is related to Josias'; there is further verification of Francis Martin's closeness to Josias; and there are neighbors here in King George who all turn up in Frederick/Culpeper/Fauquier counties later in the 1700's, thanks once again to Mary Fugate's insistence on accuracy.
