I found the will of Hugh Forgey in Bourbon County, KY. The Forgy book says that he died September 5, 1837; that is incorrect--it is the day he wrote the will. The text:
"I Hugh Forgey of the County of Bourbon and State of Kentucky do hereby make my last will and testament in manner and form following that is to say
"First I desire that all my personal Estate be advertised and sold to the highest bidder on twelve months credit some time in the month of October next and that on the day of sale that my tract of Land my late place of residence be rented to the highest bidder until the first day of March 1839 except it be rented previous to that time and that the same be rented from that time yearly till my death.
"And I do hereby appoint James L. Brown my legal agent to sell all my personal Estate and to rent out my land in manner aforesaid which I do hereby authorise him to do for me and in my name for which services he shall be paid a reasonable compensation. Secondly that after my death I desire that all my land and whatever real Estate I may die seized and possessed be sold by my Executor herein after named upon such terms and payments as may be deemed most advisable and out of the moneys assessing from my estate I desire that first-that such of my Just debts as shall remain unpaid be paid off-after which I desire that all the proceeds of my Estate I give to my children herein after named equally to be divided among them namely my son James Forgey Hugh Forgey Andrew Forgey John Forgey and Michael Forgey and my daughters Polly ?? Ludicy Stone Peggy Berry and Elizabeth Stone the two Last named Daughters having departed this life I desire that their equal portions go to their children equally.
"And lastly I do hereby constitute and appoint James L. Brown Executor of this my last will and Testament hereby revoking all other or former will or wills by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 5th day of September 1837.
