I can only assume these records are in the actual possession of the orphanage???
If that is true, then a legal question is not the thing as they are probably not a government agency nor under the direct control of a government agency.
A private adoption agency or orphanage can make up their own rules about privacy or access.
Have you found this orphanage in the 1920 Census? That might give some information you do not already know.
Can you privately email me all you know about these two people? I might be able to better digest your question.
