Will Records of Scott Co., KY, 1844-1847, Vol. J., Pages 1-2

In the name of God Almighty Amen, the twenty first day of March in the year of our Lord Christ one thousand eight hundred and forty two. I Mareen Duvall of Scott County and State of Kentucky being unwell and weak in body, but of perfect sound mind and memory for which I thank God, but calling to mind the mortality of my body, and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament. And first I give and recommend my immortal soul to God, not doubting but I shall receive the same again by the mighty power of God who gave it me in the general resurrection. Secondly, my body to be buried in a christian like and decent manner at the direction of my executors. And as touching such worldly goods wherewith it hath pleased God to bless me in this life, I give, devise, and dispose of all the same in the following manner and form (to wit,) first my just debts to be paid, secondly I give and bequeath to my beloved wife Martha Duvall twelve hundred dollars in money during her natural life, also I give to her my said wife all my household and kitchen furniture to be disposed of according to her own pleasure, and at her death I give and bequeath to my son Richard M.J. Duvall two hundred and fifty dollars in money, in addition to the money and property as charged in my book kept for that purpose, and I give to my son Edward two hundred and fifty dollars in addition to the charge in my book for that purpose. I give to my son William Six hundred dollars, because I have never given him a single dollar. I give to my Daughter Eliza D. Briscoe one hundred dollars. I give to my daughter Sophia A. West one dollar. I give my daughter Maria Williams one good bead (sic.) & furniture. I give to the children of my daughter Maria F.G. Reser deceas’d as follows (to wit) To Martha M. Peak one cent, to Ann Eliza Pickett one cent, to Charles W. Reser one cent, to Sophia A. Jones one cent, to Hellen M. Baker one cent, to Napoleon Reser one cent, to Leonidas Reser one cent. And I do hereby appoint my wife Martha Duvall my Executrix and my son William C. Duvall my Executor to this my last will and testament, and there shall be no appraisement or expence, only the recording this instrument. And I do hereby ratify and confirm this to be my last will and testament. In Testimony whereof I have set my hand and seal the day and date first above written.

This instrument of writing purporting to be

p. 2
the last will and testament of Mareen Duvall dec’d was this day produced in open court and proven by the oath of F.C. McCalla and Richard Thompson, the subscribing witnesses thereto and ordered to be recorded

Att. John F. Johnson, Clk, by
Thos. Kelly Dy (Deputy?)

(Note – There was no further record of the estate in the will records of Scott Co., KY. Mareen Duvall stipulated that there was to be no appraisal of his estate or recording of expenses. I found no record of an estate for Martha Duvall although there were such records for women in the county. The will is the apparent reason that “Mareen Duvall of Middle Plantation” lists Mareen and Martha with two daughters named Maria. A copy of the handwritten will can be found at familysearch.org. Will records for KY have been made available on-line at no charge. John D. Hoff, 5 Feb. 2012.)
