As to my worldly substance which God hath been pleased to bless me with, I Desire it may be disposed of in the manner & form following. Item My will is that my Debts be collected, and all the Just Demands against me be satisfied and paid - - - Item. I give and bequeath unto my beloved Daughter Eliz'th Smith a Negro Woman named Isbel & her increase to her own proper use, to dispose of by Will or otherwise hire them out year by year in that manner as She may think proper. Or to sell them, if she sees cause so to do. In like manner to do with the rest of the property given her also that part of my Estate which I shall hereafter mention that is to say a Childs part - - - with her three children by Barber both real and personal as here after Directed & Division Made - - - Item. I give and bequeath unto my son Daniel M. Dulany all that Tract or parcell of Land whereon he now liveth, lying and being in the Co'ty & State afores'd on the South side of the No. East of New River agreeable to Deed given unto me by Christopher Dudley Esq'r for the said Land with all the priviledges & appurtenances to the same belonging --- ---- ---- ---- I also give him my Negro Man Luke and boy Hercules ratifying all and singular what property hath been given him heretofore - - - Item. I do hereby ratifie and confirm all and singular what I gave my well beloved Daughter Ann M. Borden at her Marriage and since - further more I give and bequeath unto her one Negro Woman Named Anna boy Anthony and boy George - Also one fourth of the property left to be Divided and fourth of my Cattle and Sheep not otherwise given --- --- --- --- Item. I do hereby ratifie and Confirm all and singular what I gave unto my well beloved Daugter Rachel Ward at her Marriage and one Negro Woman Named Finette called Bun with her three children with their increase for ever - Also the young sorrel Mare my Common Dining Table and one arm Chair - with one fourth of what may be sold, & of Cattle & Sheep Item. I give and bequeath unto my son Benj'm F. Dulany the Land and plantation where on I now live the Sound plantation and Land also with all the priviledges to the same belonging According to the Titles I hold each of them by - and three hundred and thirty four acres of Land on both sides the great Swamp in s'd County as may appear by the Titles & etc. I also give him the house wherein I now live with two best Beds and firniture the house & Kitchen utensils his Brother Johns gun Horse and Wearing apparel. putima (?) & [word faded in fold of paper], one Yoke of Oxen all the hogs with Carts ploughs and all the plantation tools whatever. two stocks of Bees(?), one hand Mill one half of Corn, Bacon & pork on hand, all the Money Due me after my Debts is paid with one fourth of my Cattle & Sheep - I give and bequeath to him the following Negroes (to wit) Old Lucy, Harry, Owen, Esther and increase and Cape - Notwithstanding the above bequeath my Desire is tho B. F. Dulany be mentioned as Executor he may not be permited to act, nor able to give a right or title 'till he is twenty one years of age and then if he sees Cause let him qualifie. My Will is that the Crop now planting should be regulated and Divided as above Item I give and bequeath unto my two grandsons Thomas D. and John L. Barber, one Negro boy named Sanders equally Divided between them when Thomas comes to the age of twenty one years. The boy Sanders to be hired out annually by my Exec'r hereafter named for Schooling or Necessaries as may be most needful for Said Tho. & Jn'o Barber. if either should Decease before they come to the age of twenty one years the s'd Sanders to be entirely the others. I also give each of them a Childs part with their Mother of the property left to be sold and Divided --- --- --- Item. I give and bequeath unto my grand Daughter Helen D. Barber fifty acres of Land in fork of Wallace Creek I Bo't of Ben Melton as by patent & Deed may appear also a Childs part with her Brothers & Mother as above Item My Will further is that the Land on both sides of Wallaces Creek of mine be Sold also all the Turpentine on Land Tar kiln Brilliant, old riding Chair and all my other property (Except Cattle & Sheep) be sold & Divided Between Eliz'th & Children. Dan'l Ann & Rachel Item. I request that my burial may be with common Decency and my bones carried & laid by your Mothers - lastly I hereby constitute & appoint my two sons, Dan'l M. Dulany and Ben'm F. Notes for Daniel Merril Dulaney: Daniel Merrill Dulaney, born 15 June 1783 in Onslow Co NC and died 27 May 1848 in Holmes Co MS.His first wife was named Mary and his second wife was Alice Ward Loomis, a widow of Dr. Nathaniel Loomis. My Daniel M. Dulaney is the grandson of Thomas ( and Annie) Dulaney who was born in Baltimore.My Daniel's parents were Thomas Dulaney,( son of Thomas & Annie,)and Helen Newton, daughter of John and Elizabeth Newton.
