In the name of God Amen. And in the year of our Lord God one thousand eight hundred and six

I John Higgins husbandman of the county of Barren, state of Kentucky, being in a low state of health but of perfect mind and memory, thanks be given to God, therefore and calling to mind the

mortality of my body and knowing that it is appointed for all to die, do make and ordain this as my last will and testament, viz first and principally of all I give and recommend my soul into the hands

of God that gave it and my body to the earth to be buried in a Christian like and decent manner at the discretion of my executors to be hereafter mentioned and as touching such worldly estate as it hath pleased God to bless me with this life I devise and bequeath in the manner and form following, viz Imprimis I do give devise and bequeath unto my truly and well beloved wife Elizabeth Higgins one bed and clothing with the household furniture to be at her disposal, also two milk cows and a year old steer, also one third of what remains of my estate not hereafter bequeathed.

Item I give, devise and bequeath unto my oldest son Hugh Higgins one dollar.

Item I do give devise and bequeath unto my daughter Mary King one dollar.

Item I do give devise and bequeath unto Margret Wright one dollar.

Item I do give devise and bequeath unto Isable Boyd one dollar.

Item I do give devise and bequeath to Eleanor Higgins one cow and calf.

Item I do give devise and bequeath unto Samuel Haggins my house Bible & burket [?]one the new Testament.

Item I do give devise and bequeath unto John Hoggans two cows which he owed by contract and my saddle.

Item I do give devise and bequeath unto Agness Findly one dollar.

It is further my will and pleasure that one hundred acres of wood land lying on the ridge between Samuel Boyd and George Findly be sold by my executors and the money arising therefrom to pay the former legacies and the remainder together with the debts due to me, a third to my wife as

before mentioned, the other two parts to my daughter Eleanor Haggins and I do by these presents nominate constitue [sic] and appoint as executors of this my last will and testament my trusty and well beloved sons William and Samue[sic] Haggans disallowing of all others at any time

heretofore met... and I do by these presents utterly disallow disanul [sic] and revoke all other wills or legacies by me formerly made other [sic] by work of mouth or writing ratifying and confirming this and this only as my last will and testament. In witness whereof hereunto set my hand and seal this 11th of April one thousand eight hundred and six.

The foregoing writing purporting to be the last will of John Hogins deceased was produced in court and George Finley one of the subscribing witnesses being sworn deposeth that the said John Haggans did in his presence deliver the said writing as his last will & that he believe him to be in his proper sense & memory when he did it & again at a court held for said county the 17th day November & year aforesaid, James Finly the other subscribing witness being sworn deposeth that the said John Haggins did in his presence deliver the said writing as his will and that he believes he was in his proper sense when he did the same & thereupon the said writing was ordered to be recorded as the true last will & testament of the said John Haggins Dec'd.

Note:
1765 March--David appears in the records of Isle of Wight Co., VA when he sold 50 acres of land for 10 pounds to Hannah Briggs. He was identified as a cooper of Newport Parish.

Mill Swamp Baptist Church records show his first 5 children's births: Ann on Dec 22, 1765; Loas [Lois] on June 26, 1767; William on Jan 13, 1769; Anna on Dec 27, 1771; and Wat (male) [Wait] on Oct 4, 1774. David Strait is listed seventh on male membership list of the Mill Swamp Baptist Church; Hannah Briggs is listed fourth on female list, and Ann Strait is fifth.

2 Sept 1779 David and wife Ann sold their land to Nathan Ward (believed to be Nancy's nephew) on for 30 pounds. This may reflect the time of their moving from VA to NC.

In 1783 David bought 125 acres lying on both sides of Utley Creek in Wake Co. NC for 30 pounds from Henry Kent, recorded July 7, 1785.

Marriage of David Strait to Priscilla Manning, bond dated 7 March 1786 in Wake Co. NC.

1790 Wake Co. NC census has 2 males over 16 (David Sr. and William); 2 males under 16 (Israel and David Jr.) and 5 females (Priscilla and which 4 daughters? With a step-mother, perhaps a couple of the older girls were working out of the home at this time.)

Last will and testament, dated 22 Nov 1791 and recorded 5 Nov 1792, on file in Wake Co. NC (Bk C p 240), names wife Priscilla, oldest son William, son Israel, son David, dau Amy Riggins [should be Anny Ragan], daus Lois, Nancy [from births, this appears to be Nancy Anna], Wait, Dorcas, Sarah, Selah Strait. So Wait turned out to be a daughter.

Inventory of the Estate of David Strait, Dec'd, taken July 30, 1792:
"Two mares and bason molds, and plate molds and spoon molds, one rifle gun, & a small quantity of powder and lead, one man's saddle and bridle, nine yards of new cloth, one razor, some outstanding debts the amount not yet known, fourteen shillings & seven pence half penney hard money and two shillings paper money, one tukler bottle, some furr the quantity not known. Signed William Strait, Exe."

Not long after David's death, the oldest son William took at least most of the family to Warren Co. KY It appears that Sarah stayed in Wake Co. with relatives,[maybe with her sister Anny/Amy Ragan, or her sister Wait Olive as a mothers helper] as it looks like she married William Goodwin there in 1806.

Isle of Wight Co. VA Mill Swamp Baptist Church records has "Ann Strait daughter of David Strait was born December the 22nd, 1765." There is also "Anna Strait daughter of David Strait was born December the 27th, 1771". [Which I believe, because of the sequence, and the listing of an Amy Riggins, is the Nancy listed in David's will, so think this younger daughter's name was Nancy Anna]
Listed as Aney or Amy Ragan age 84 in 1850 Wake Co. NC census, making her the Ann born Dec 1765. (Some have thought her age is given as 81, but I have xeroxed and studied the film, and I am confident it is 84)
In the Olive Chapel Baptist Church records of Wake Co., Willis Ragan and Ama Ragan are listed as members in 1850. Then death for Willis is given as 13 Jan 1856, and for Anna Ragan just "1856". We are presently assuming that the Ama Reagan and the Anna Reagan are the same person. More research is needed to clarify this situation.

At present, it is believed that Lois married a Mr. Edwards after 1791. There is a marriage of a Lois Edwards to Tignal Wade in Warren Co. KY 20 March 1799, at which time her Security William Strait proved her over 21.
Cynthia Wade was born about 1794, about 5 years before Lois married Tignal, so Cynthia is probably either Lois' daughter from her marriage to Mr. Edwards, or is Tignal's from a previous marriage, but for now we are listing her with the rest of their children.
Loiz [sic] Wade is listed on 1823 Allen Co. Tax List after Tignal had been listed previously, from 1816 (no land).
By 1830 Tignal is alone in the Warren Co. TN census (why did he go to TN??), and there is an elderly female in the home of John Wade in Allen Co., which we suspect may be Lois living with her son. By 1840 Tignal has remarried.

1808 and 1813 lists of messengers for the Bethlehem Baptist Church on the Upper Difficult (organized 31 Jan 1801 as the Difficult Baptist Church) included William Straight. In a printed account of the church, "History of Bethlehem Missionary Baptist Church" it states that "The church was constituted with eight members: James Atwood and his wife Margaret, William Strait and his wife Dorcas, William Thomas and his wife Mary, Thomas Spillman, and Polly Richey [Richardson in another account]. Elder Joseph Logan was chosen as the first pastor."
William is listed as a messenger for the church in 1802, 1808 and 1813.
In the 1810 Warren Co. KY census, it appears that there were two female relatives living in his home-- probably his sister Selah is the female in 16-26 age range, and maybe one of his old maid sisters, perhaps Nancy or Dorcas, is the female in the 26-45 age range. The males would be sons Able (16-26), Briggs (10-16), William Logan and Grey Benjamin (0-10), and the daughters would be (probably) Piety and Winifred (16-26), Temperance (10-16), Elizabeth and unknown female (0-10).

In 1820, there is again an unknown female in the 16-26 age range. Selah, Abel and Piety have married prior to this census, so do not show in the home. Briggs (16-26), William Logan and Grey Benjamin (10-16), and Wright and Enoch (0-10) would probably be the males.
In 1830, William (60-70) and wife (50-60) have "old maid" Temperance still at home in the 30-40 range, but no other females. The males were William Logan (20-30), Grey Benjamin and Wright (15-20), and Enoch (10-15). (Enoch was actually more like 17.)
1840 Allen Co. KY census (p 15/58) shows William Strait 70-80 with 1 male 5-10, 2 15-20 and 1 20-30; female 60-70 with 2 5-10, 2 10-15, 1 15-20, 1 30-40 and 1 40-50. Elizabeth Jackson is a widow (30-40) with 6 young children, and apparently they are living with William and wife. Also still at home is Temperance 40-50 and Enoch, the 20-30 year old male. William also has two of his deceased son Abel's young daughters with him--Mary Francis (who later marries Enoch) and Constance. [Allen Co. Day Book, p 127, 130]
1850 Allen Co. KY census (house #868) lists William Strait 81 year old widower with dau. Elizabeth Jackson 45 still living with him, as are son Enoch 37 and his wife M. F. 27 and 7 year old female M. F.
Allen Co. KY Deaths reported during the 1852-61 period include William Strait age 86 widow b NC son of David Strait, mother's name not known. He was listed as physician, and died from the flux.

or the same woman as Dorcas? She could have been Mary Dorcas, and called Dorcas, but when she signed a legal document, used Mary.

If David was 21 when he married in Oct 1807 to Sally Thompson, he would have been born sometime before 1786; in the 1810 census he is in age range of 26-45, which means he would have been born 1784 or earlier; in the 1830 he was in the 40-50 year range and in 1840 in the 50-60 year range. Considering all of this, and the fact his birth was not recorded in Mill Swamp Baptist Church, but all census records report his birth as NC, we place his birth as after 1780 and before 1784, so "about 1783".
In the 1810 census he had 1 male under 10 and 2 females in the 16-26 range, which would indicate the presence of an older female other than his wife. This might be one of his or her sisters.

He married Charlotte Pinson 14 Nov 1820, so she wouldn't appear in the census for 1820. Possibly his first wife Sally was still living at the time of the census but died in childbirth in the fall.

In 1820 census, besides himself, there is one male 0-10 (which would be Hosea H. b abt 1813, and 1 female 10-16 (which would be daughter Nancy b after census in 1810); and 1 female 26-45 (presumably Sally).

1830 Allen Co. KY census ( CAN'T LOCATE REFERENCE! ) shows David with
1 male under 5; 1 5-10; 2 15-20; and 1 40-50. (James W. b abt 1829, unknown 5-10 yr old [could this be a son born after census in 1820, at whose birth his mother may have died? or a son of David and Charlotte, whose name we do not know, but as he not named in the 1842 will, perhaps he died about 1841], Hosea H. and another unknown male age 15-20, and David)

1840 Allen Co. KY census (p 3 line 3) shows David Street with: 1 male under 5 (Perry P.), 1 5-10 (David Betheul), 1 10-15 (James William), 1 15-20 (same? unknown male that was 10 years younger in 1830?), and 1 50-60 (David);
1 female under 5 (maybe a daughter who died before his will in 1842, or the daughter of the unknown adult female in the home), 1 10-15 (Emaline), 1 20-30 (WHO? as Nancy was already married), and 1 30-40 (Charlotte). Are the "extra" male and female perhaps Hosea and wife Nancy living with his parents after their marriage in 1839? Not likely, as there is an H. H. Street listed on the next page of the right age to be Hosea and his wife; no children.

Since Abel's son William Chesley was bound to David after Abel's death in 1833, he should appear with David's family in 1840; but who would be the 5-10 year old male in 1830 if the 15-20 year old male in 1840 is William Chesley??

Allen Co. KY census shows two Thomas Sears. Allen Co. Wills and Settlements (printed abstracts p 33) shows Thomas Sears making his will 19 May 1846
and having it proved 13 July 1846:
"To my children, Raleigh G. Sears, Bradford Sears, Louisa Burton, Frances Ann Sears and Martha Sears, two tracts of land on Drakes Creek purchased
from Zachariah Smith. To my children Christiana Sears, Calvin Sears and Fielding Sears, I give homeplace on Long Creek. To daughter Christiana Sears, my
negro Palmira. To daughter Marthena Carpenter, two tracts of land on Difficult Creek [one on which Levi Spilman now lives and the other adjoining the land of
William Strait]. To son Fielding Sears and to my daughters, except Marthena Carpenter, one bed and furniture. All the balance to my four children, Fielding
Sears, Christiana Sears, Frances Ann Sears and Martha Sears, they being the only children now at home with me. Sons Raleigh G. and Bradford Sears, my
