In the name of God Amen the 22nd day of August in the year of our Lord One Thousand seven hundred & ninety five I Joseph Brown of Bedford County State of Virginia being weakly in body but of perfect mind & memory thanks be to god & calling to mind the mortality of my body and knowing it is appointed for all men once to die do make & ordain this my Last Will & Testament that is to say Principally & first of all I give and recommend my soul into the hand of Almighty God that gave it. My body I recommend to the Earth from whence it came to be buried in a Christian Like manner at the discretion of my Executors. Nothing doubting but at the General Resurrection I shall receive the same again the mighty Power of God, and as touching such worldly Estate wherewith it has Pleased God to bless me in this life I give, Demise & Dispose of the same in the following Manner & form.

Item        I give & bequeath to my beloved wife Elizabeth Brown all my Personal Estate with the Land & appurtenances whereon now I live during her life or Widowhood.

Item       I give & bequeath to my son Jesse Dent Brown One hundred & thirty Acres of Land which I bought of William Brown to him & his heirs forever, also one mare & saddle already delivered.

Item       I Give & bequeath to my son Rhodham Brown one half of a Tract of Land on head of Beaver Dame which I bought of Joseph Blankenship that half adjoining John Yates to him & his heirs forever, Also bay horse & saddle Already Delivered.

Item       I give & bequeath to my son Joseph Brown Two hundred thirty acres of Land being the manor Tract whereon now I live to him & his heirs forever, after my wife Elizabeth Brown Decease or Widowhood. Also one black horse & saddle already Delivered.

Item       I give & bequeath to my son Hezekiah Brown the one other half of the aforesaid Tract of Land which I bought of Joseph Blankenship next to the grind stone Quarry also mare colt called Tammy & silver watch to be Delivered to him at his arrival to Eighteen Years of age, the said the said Land to him & his heirs forever.

Item       I give & bequeath to my Daughter Orpah Brown Twenty five Pounds Lawful Money of Virginia to be paid out of my Personal Estate after my aforesaid wifes Decease.

Item       I give & bequeath unto my Daughter Sarah Brown Twenty five pounds Lawful Money of Virginia to be Paid out of my Personal Estate after my aforesaid wifes Decease.

Item       I give & bequeath to my Daughter Marget Brown Twenty five Pounds Lawful Money of Virginia to be raised out of my Estate after my aforesaid wifes Decease and after Paying off my Just Debts and my three Daughters their above mentioned sums of money what remains of the said Estate to be equally Divided among my four sons & three Daughters above mentioned. And I desire that my son Hezekiah Brown should have three months schooling and Orpha three months. And Sarah Twelve Months and Margaret Eighteen months more than what they get this Present Year the same to be paid for out of the Estate –

And I do hereby Constitute and appoint my two sons Jesse Dent Brown & Rhodham Brown my only & sole Executors of this my Last Will & Testament, and I do hereby utterly Disannul and revoke all other Testaments with Legacies Bequests & Gift by me in any wise before named will I Bequeathed, Ratifying and Confirming this & no other to be my Last Will & Testament.

In Witness whereof I have hereunto set my hand & seal this day & year above written.

Signed sealed Published and Pronounced by the said Joseph Brown as his Last Will & Testament In the Presence of us the subscribers (Viz) –

Sarah Dent - her X mark

At a Court held for Bedford County the 26th day of October 1795 ------

This Last Will & Testament of Joseph Brown Deceased was proved by the oath of William Dent & John Dent Witnesses who names are thereunto subscribed & ordered to be recorded. And on the motion of Jesse Dent brown & Rhodham Brown the Executors therein named who made oath thereto Certificate is Granted them for obtaining Probate thereof in due form on Giving security whereupon they together with John Dent their security entered into & acknowledged their bond in the Penalty of five hundred Pounds conditioned for the said Executors due & faithful Administration of said Decedent’s Estate & Performance of his Will.
