This Indenture agreed and entered unto this 18th day of February eighteen hundred and thirty ____ James Cotterall Sr of Bedford County of the first part. Marquis D. Gray of the second part and Thomas L. Leftwich, Thomas L. Leftwich and Samuel Williams of the third part, witnesseth. The said James Cotterall Sr. being justly indebted to the said Thomas L. Leftwich _______ account which is open and amount unknown, and to Thomas L. Leftwich Sr. on a merchants account which amount is also unknown and that Samuel Williams ___ the sum of six dollars and fifty cents on 1st day of May next ____ for the purpose of securing the said debts with all interest which is accrued thereon, the said James Cotterall Sr hath granted, bargained, & sold and by these presents doth grant, bargain, & sell unto the said Gray the following property to ___ all his interest in the crop of tobacco made by Daniel McCann, Nelson McCann and the aforesaid James Cotterall Senr in copartnership to have and to hold the said interest in said crop of tobacco to the said Gray his heirs and assigns forever, and the said James Cotterall hereby convenes and agrees to support and defend the title to said Gray, his heirs & assigns against the claim of himself and his heirs and against the claim of all and _____ whatsoever. Yet upon this special trust and confidence nevertheless that in case the said James Cotterall Senr shall fail to pay the said Thomas J. Leftwich and all the aforesaid creditors their debt with all reasonable charges then in that case it shall be the duty of the said Gray or his representatives ____ being required to do so by the aforesaid creditors their exors or assigns to advertise at the front door of the courthouse of this county for ten days prior to day of the sale, and sell his interest in said tobacco, to the highest bidder for ready money and out of the proceeds of said sale first pay the cash of money and recording this deed, then pay over to Thomas L. Leftwich & Thomas L. Leftwich Sr the amount of their debts in full of said sales should cover in as much, if it should not, said two first mentioned debts stand upon the same footing, and if it should turn out in evidence that said sales of said tobacco should yield a surplus then in that case made and provided said Williams shall be entitled to his debt and interest if enough to satisfy him and after paying him if there should there still a surplus exist it is to be paid out tp Barbara Kerns on a debt due for the sum of twenty dollars and thirty four cents, and if there shall still be a surplus payment to said James Cotterall his heirs and assigns. But if the said James Cotterall fails to fully pay and satisfy thy debts in hand and amt aforesaid in anytime say two months from the date of this deed then this to be paid ______ in full force _____. _________ whereof the ___ present ___ their hands and affixed their seals to ___ and year first above mankind.
