1831 Henrico Co., VA Chancery Case of John P. Cottrell and Mary Cottrell

To All:

Here is a Henrico County Chancery case that involved John P. Cottrell against his sister Mary Cottrell. John P. Cottrell , Mary Cottrell, along with a Richard Cottrell (dec'd) were the children of Chas. Cottrell according to the case.

I don't know for certain if anyone has actually looked at some of the court cases that I have recently received in the mail. Cause there some information I've never seen mentioned by any previous researcher or published material.

According to the case there is a Benjamin Cottrell that is an uncle to John P. Cottrell.

To the Sergt of the city of Richmond City of Richmond to wit.
Cottrell vs Cottrell } Chancery

1830. April 7. Samuel Cottrell is by the court assigned guardian adlitern to the infant deft. to defend her in this writ and by consent heard on bill and answer & decree according to (wugh?) filed.
1831 Augt 2d Jesse Snead on of the Commrs. apptd. by the decree pronounced in this case on the 7th April 1830 declining to act Saml Brown and others apptd. to carry the same onto affect any 3 of whom may act. see entry

To The worshipful county court of Henrico in chancery setting,

Humbly complaining therewith unto your worships your orator John P. Cottrell that on the ___ day of _____ 18 Charles W. Cottrell departed this life first having made & published his Last will & Testament. That he thereby devised to your orator and your orators brother Richard Cottrell eighty acres of land lying in the county of Henrico. That after the death of the said Charles W. Cottrell the said Richard also departed this life during his infancy & intestate. That your orator has an infant sister, Mary Cottrell, who together with your orator are the only children & heirs of there father Chas. Cottrell decd & brother Richards That by the death of the said Richard the said Mary is entitled to one fourth part of the said eighty acres of Land. That on the ____ day of _____ AD one Benjamin Cottrell the uncle of your orator & the said Mary departed this life intestate seized of some real estate in the said county. That this real estate has been divided between the heirs of the said Benjamin Cottrell & fifty eight acres thereof assigned in that division to your orator & the said Mary. That the orator & the said Mary hold also jointly by the six following slaves, to wit Lucy, Lewis, Robert, Moses, Amy & Smith. That your orator is delirious of having the estate both with personal estate thus held jointly with the said Mary divided & the portion of each respectfully assigned to each, with this view your orator pray that the said Mary by some proper person appointed by the court infered him in this writ, be made Dept hereto decreed to answer the same. That this worshipful court will appoint commissioners to divide the said property both real & personal according to rights of each of the parties witnessed thereto & make proper appointment thereof that your worships will grant to your orator such other & general relief as to your worships pray seem just & proper.
The Answer of Samuel Cottrell guardian appointed by the county court of Henrico to defend Mary Cottrell an infant dependant in a bill of complaint exhibited against her in the county court of Henrico by John P. Cottrell.
This despondant for answer to the said bill says that the facts therein stated are true & that he submits to the court to pro noence such a decree as to them shall seem proper.

Cottrell v Cottrell } The court having assigned Samuel Cottrell guardian to defend the infant deft Mary Cottrell & this court convey on this day to be heard upon the bill & answer of the said deft by her guardian was argued by counsel where upon the court doth agree and order that Jesse Sneed, Malachi Tursley & Thomas Dicken be appointed commissioners to divide the land & slaves in the bill mentioned between the plaintiff John P. Cottrell & the deft. Mary Cottrell. That in the said allotement & division that they assign to the said Mary twenty acres of the said eighty acres in the said bill mentioned, & that the said commissioners divide equally the said fifty eight acres of land in the said bill mentioned & the said six slaves having reference to both (??????) & value in the said division & that they do assign one equal portion thereof to the Pltf. John P. Cottrell & the other equal portion thereof to the Deft. Mary Cottrell & make report to this court for further proceedings therein to be made.
