SUBSTITUTE TRUSTEE’S SALE
WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust executed on January 16, 2004, by Wayne A. Cooley to PRLAP, Inc., Trustee, as same appears of record in the Register’s Office of Humphreys County, Tennessee, under 187, Page 743, (“Deed of Trust”); and
WHEREAS, Bank of America, NA, the current owner and holder of said Deed of Trust (the “Owner and Holder”), appointed the undersigned, Priority Trustee Services of TN, L.L.C., as Substitute Trustee by instrument filed for record in the Register’s Office of Humphreys County, Tennessee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Owner and Holder, and that the undersigned, Priority Trustee Services of TN, L.L.C., Substitute Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him, will on Thursday, July 20, 2006, commencing at the Main entrance of the Humphreys County Courthouse, Waverly, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Humphreys County, Tennessee, to wit:
This being a certain parcel of land in the 2nd Civil District of Humphreys County, Tennessee, in the City of Waverly, lying West of and adjacent to Mill Street and South of and adjacent to Daniel Street and being more particularly described as follows:
Beginning on a chain link fence corner in the West margin of Mill Street at the Northeast corner of the Nina Sue Hendon and Mildred Hopwood property of record in Deed Book 169, Page 535, Register’s Office of Humphreys County, Tennessee; thence with the North boundary of said property North 88 degrees, 19 minutes, 36 seconds West 177.78 feet to a placed iron pin in the East boundary of Charles Monroe property of record in Deed Book 165, Page 182, Register’s Office of Humphreys County, Tennessee, thence with said boundary North 2 degrees, 28 minutes, 40 seconds East 145.81 feet to an existing iron pin in the South margin of Daniel Street; thence with said margin South 88 degrees, 30 minutes, 04 seconds East 178.50 feet to a placed iron pin in the West margin of Mill Street; thence with said margin South 2 degrees, 45 minutes, 15 seconds West 146.36 feet to the point of beginning, containing an area of 0.60 acre by calculation. Survey made by McBride Survey Co. 4/24/01. Being same property conveyed to Wayne A. Cooley by deed of record in Deed Book 181, Page 1652, Register’s Office of Humphreys County, Tennessee.

The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose.

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
