Records of Confederate soldiers were assembled by the U.S. War Dept. a century ago and microfilmed much later. In contrast, most U.S. service files from the Civil War have never been microfilmed.
Some Confederate veterans described themselves as having rank when they simply acted in a certain capacity. In Brown's case, he well may have acted in place of the AQM of his regiment, whose rank was captain. That's my best explanation as to why he would use this rank.
Brown's service files (45th and 1st Alabama Regiments) include a physical description made at enlistment. Please contact me if I can help with copies.
