The People of the State of New-York, by the Grace
of God, Free and Independent : To all to whom these Presents shall come, or may concern, send Greeting :

KNOW ye, that at Burlington in the County of Otsego, on the thirteenth day of March in the year of our Lord one thousand eight hundred and nineteen before Nathaniel Fenton Esquire, Surrogate of our said County, the last Will and Testament of Sylvanus Southworth deceased, (a copy whereof is hereunto annexed (was proved, and is now approved and allowed of by us; and the said deceased having whilst he lived, and at the time of his death, Goods, Chattels, or Credits, within this State, by means whereof the proving and registering the said Will, and the granting administration of all and singular the said Goods, Chattels and Credits, and also the auditing, allowing and final discharging the account thereof, doth belong unto us ; the administration of all and singular the Goods, Chattels and Credits of the said deceased, and any way concerning his Will, is granted unto William Southworth Executor in the said Will named, he being first duly sworn well and faithfully to administer the same, and to make and exhibit a true and perfect inventory of all and singular the said Goods, Chattels and Credits, and also to render a just and true account thereof when thereunto required. In testimony whereof, we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness Nathaniel Fenton Esquire, Surrogate of the said County, at Burlington aforesaid, the thirteenth day of March in the year of our Lord one thousand eight hundred and nineteen and of our Independence the

In the name of God amen. I Sylvanus Southworth of Burlington in the county of Otsego & State of New York being weak in body but of sound mind and and perfect mind and memory blessed be almighty God for the same do make and publish this my last will and testament in manner and form following that is today. First I give and bequeath unto my beloved wife Betsey the use of the square room in the South East corner of my now dwelling house together with a privilege of doing her work in the kitchen and a privilege of putting her firewood in the wood house also a privilege of using the cellar & chamber as shall be necessary for her all of which said rights and privileges I give and bequeath unto her to have and to hold and enjoy so long as she shall remain my widow.

I also give and bequeath unto her a sufficiency of the annual profits of my farm in Burlington to yield her a comfortable support during her natural life. I also give and bequeath unto my said wife our feather bed and bedding and such other articles of house hold furniture as she shall stand in need of for her comfort and convenience. I also give and bequeath unto her our side saddle to have and to hold during her life and my clock to have and to hold so long as she shall remain my widow. I give and bequeath unto my son Truman our sucking colt.

I give and divide unto my three Sons Tracy Schuyler & Truman all of my real Estate to be equally divided between them subject to the provisions I have above made for my wife. And it is expressly my will that they should hold the same as tenants in common and make no partition then of until my son Truman shall arrive at the age of twenty one years if he should no longer live until which time it is my will that the annual profits of my real estate be disposed of in manner following that is to say first allowing to my wife the provisions above made to her out of the same. Then out of the ***** of the same profits that my two sons Schuyler and Truman receive sufficient to board and school them four months in each and every year untill they respectively arrive at the age of twenty one years--After deducting which from the said annual profits of my real estate it is my will that the residue of the said profits be equally divided between my three sons Tracy Schuyler & Truman--

I have heretofore paid a certain sum of money for my son Tracy and have also given him a colt a rifle & a watch amounting in the whole to two hundred dollars--

Now it is my will that after payment of all my debts that all my personal property of what I own name or +++ (excepting the colt above bequeathed to my son Truman and such articles as I have above bequeathed to my wife be divided amongst my three sons Tracy Schuyler and Truman in such a manner as to make them all equal reference being had to the sum of two hundred dollars above mentioned as said given and advanced to my son Tracy which said sum is to be counted a part of his portion out of my personal Estate. And it is my will that the articles of personal property above disposed of to my wife during her life or so long as she shall remain my widow be equally divided between my three sons on her death or intermarriage.

And I do appoint my well beloved wife Betsey the Guardian of my Infant children during their minority respectively--

And I do also appoint my well beloved brother William Southworth of Brookfield in the county of Madison the executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this twenty eighth day of November one thousand eight hundred and eighteen.
