James B. Roy was a bus driver and his brother-in-law, James Todd, accused him of not treating his kids right. Todd pulled out a 38 and shot Roy in the stomach - he died in 15 minutes.

Feelings for Sometime.

Jim Todd shot and killed James Roy at St. Vrain Wednesday morning of this week. Roy drives the school truck at that place and had just come in from his route bringing the children to school. After the children had gotten out of the truck Roy drove to the garage nearby and was having his car filled with gas. It seems from the report given by eye witnesses that Todd approached Roy here, and there was some conversation as to whether the driver of the school car had properly treated Todd's children, whereupon it is said Roy was heard to have said: "The trouble is not with the children but with you." It is said, men had exchanged only a few words until a shot rang out and Roy was mortally wounded with a bullet wound through his abdomen coming from a 38 calibre pistol. Roy died in about fifteen minutes and as far as the News has been able to learn made no dying statement.

Only one shot was fired by Todd and it is said that Roy was unarmed.

After the shooting Todd phoned the sheriff's office here and told Sheriff Dean what he had done and asked that the officers come out after him. Accordingly he was brought to the county jail in Clovis by Deputy Pat Woods.

Inquest Held

Judge J. P. Noble, accompanied by the sheriff and District Attorney Compton went to St. Vrain shortly after the killing as an inquest was held.

Men Were Brothers-in-law

James Todd and James Roy are brothers-in-law, the latter being a brother of Todd's wife. There is said to have been quite a bit of feeling between the two men for the past several weeks, caused from the division of property in which both were interested. Men acquainted with both believe this possibly led up to the tragedy occurring Wednesday morning. The deceased man is survived by his wife and two children and recently moved from a farm to St. Vrain to take charge of the driving of the school trucks there. Todd has a wife and four children and lives on the Gurley farm about seven miles from St. Vrain.

Examining Trial Next Week

Todd's examining trial has not been set yet but will in all probability be held sometime next week. He has employed Rowells & Reese as his attorneys and makes no statement in regard to the killing.
