In the capture of Charleston, in 1780, Newton was takenprisoner, and soon after died of the small-pox. Severalof his friends were also taken prisoners, and some diedof the same loathsome disease. Newton’s father, the Rev.John Newton, removed into Georgia immediately after thewar, and settled near Fenn’s Bridge, on the Ogechee,where he died.

Mr. Tefft became a very prominent citizen of Savannah. He had been jointproprietor of the "Georgian" with the actor Harry James Fenn in 1821-22. In 1822he entered the service of the Bank of the State of Georgia as a clerk, was

(Dan Archie) Brown is mygrandfather._______________________________________________________________STATE OF GEORGIA...COUNTY OF CRISP ADKINS TO FENN AND BROWNTHIS INDENTURE, made this the 7th day of April, A.D., 1922,between J.A. Adkins of the County of Crisp and State of Georgiaparty of the first part,
and F.E. Fenn of Crisp County, GA., andD.A. Brown of the County of Randolph and State of Ga., party ofthe second part.WITNESSETH: That the party of the first part, for and inconsideration of the sum of One Hundred Dollars in hand paid, by the said party of the ssecond part, the receipt whereof ishereby acknowledge, and in consideration of the payment of thefurther sum or sums hereinafter mentioned, has granted, bargained,sold, demised, leased and to farm-let, and by these presentsdoes grant, bargain, sell, demise and to farm-let unto the saidparty of the second part, their heirs and assigns, all of the growing trees for turpentine purposes, now upon the following lots or parcels of land, situate, lying and being in the Countyof Crisp and State of Ga., known and described as follows: All of land lot No.50 and East half of No.47 and what turpentinetimber there is on No.48, all being in 1004 District of Ga. ofCrisp County, Ga.And also the right of ingress and egress, the right tobuild ways and roads on any part of lands whereon the said trees areare growing, and no such portion of the lands as may not haveany trees thereof if necessary or convenient to reach thetimber leased, in such shape as the party of the second part,their heirs and assigns may desire; and also the right unto thesaid party of the second part, their heirs and assigns, topeacefully enter into the possession of said lands, with their servants, agents and stock for the purpose of boxing and cuppingsaid timber and taking away the turpentine therefrom, the right to a continuous and peaceable possession of said landsunto the said party of the second part, their heirs andassigns, to be only during such time or times as they may beengaged in boxing, cupping and working said trees and removing the product; but the right of ingress and egress, the right ofways over said lands may be exercised at any and all times, continuosly or not continuosly, now or at any time hereafter, as long as the part...of the second part of assigns may requirethe same to reach any other timber that he or they may lease in the neighborhood. Together with all of the estate, right, title, interest claim and demand whatsoever of the said party of thefirst part of, in and to all of the property, rights, ways, roads and privileges above described and granted.TO HAVE AND TO HOLD said rights above described and saidtimber, to cup and box, work and otherwise use said timber forturpentine purposes unto the said party of the second part, their heirs and assigns. And it is hereby expressly convenantedand agreed that the said party of the second part may commencecupping, boxing, working or otherwise using the said timber forturpentine purposes, or any portion thereof, at any time thesaid party of the ssecond part or assigns may desire, andshall have the right to continue to cup, box, work, orotherwise use the said timber and every portion thereof forturpentine purposes for the full term of Four years, beginning,with reference to each portion of the timber, from the time onlythat the cupping, boxes and working of each portion is commenced;it being the intention of the parties that this lease shallcontinue to operate until all of the timber, and each andevery part thereof, has been cupped, boxed, worked andotherwise used for turpentine purposes for the full period ofFour years from the winter during which the cups are hung orboxes are out. And it is hereby further covenanted and agreedthat the said party of the second part, their heirs and assigns, shall have the free and unrestricted right to enter upon, occupyand use the said land for the purpose of cupping, boxing, working and otherwise using the timber thereon for turpentine purposesas aforesaid, during the continuance of this lease; and it isfurther covenanted and agreed that said party of the second part may have the right, at any time, to assign this lease inwhole or in part, and that any assignee of this lease shall have the same right of assignment, and that all of the rightsand privileges of the said party of the second part shall vestin whosoever may succeed to the inbterest hereby conveyed tosaid party of the second part.All of the rights, privileges and property aove grantedto said party of the second part are intended to be exclusive,that is to say, none of said rights, privileges and property canever be granted or sold to any other person, or persons exceptby the written consent of said party of the second part, orassigns, so long as these presents shall remain in force.AND LASTLY, the said part of the first part, for himselfand his heirs, executors and administrators, covenants withthe said party of the second part, that they, the saidturpentine trees, and the said rights and privileges untothe said party of the second part, their heirs and assigns, shall and will warrant and forever defend by these presents,not only for the full amount of the purchase money, but forall damages which the party of the second part may, in anymanner, sustain, by reason of a defective title in theparty of the first part.And the party of the second part agrees to pay to the partyof the first part as a further consideration for said turpentineprivileges and all other rights and privileges aboveenumerated, the following sums of money at the following dates,to-wit: Fifty dollars per thousand boxes when the boxes are outand counted.
