NEED ADVICE ABOUT FAMILY CEMETERY IN ONTARIO
I'd be grateful for any advice or suggestions regarding the following situation(s)....
1).Two of my ancestors (and possibly more) are buried together in a field in Eastern Ontario.The burials took place in 1853 and 1883.At the time of their deaths, my ancestors chose to be buried on their own land. Since then, the property has changed hands many times.In recent years, my ancestor's tombstone has been knocked over many times by the farmer who currently owns it..Supposidely, there were other tombstones on this site,but they've mysteriously disappeared!.I'm a bit concerned about this stone gettingdamaged.I guess my question would be:Who actually owns the burial plot (descendants or current owner) ?.Would this burial plot be protected under any Cemetery Act?.
2).Another group of my ancestors (related to the ones mentioned above) are buried on another property near by..They also chose to be buried on their own land.There are over 20 (known) burials on this property.The current owner has banned everyone (including descendants) from visiting the cemetery.The stones date back to the early
1800's.There are many genealogists/descendants of this family including myself who would like to document
this family cemetery for genealogical purposes.This includes photographing the stones and transcribing the information from the stones onto paper.As a descendant,do I have any "rights" as far as visiting this site?.I feel it's important to preserve our history for future generations.
I'd appreciate any information or stories of similar experiences.
