Will Written: Apr 8, 1823 Proved: May 1823 Court term Wife: Rebecca (Onslow Marriages says he married Elizabeth Carey but gave no date. Rebecca may be a 2nd wife)--give to Rebecca the house and cleared land adjoning them so far as a small locust tree in my peach orchard and and brought througn the neck so as to include my field on bear head during her natural life. I give the cleared land on Waleses (?Wallases) Creek side and the ballance of my peach orchard and all on the North side of the line both cleared and woodland to be equally divided between my two daughters POLLY and ELIZABETH them and their heirs for ever I mean north of the line from the locust tree to the mouth of bear Head. Son: DANIEL CARY-- 50 Acres on Wellses Fork (may mean Wallaces) on the north side of Cowhead Creek, also 50 acres more bing in Jumpenrun neckk which John Gornto was to make me a deed to which I wish made to son Daniel. Daughter: Polly Daughter: Elizabeth Item: I give at the death of my wife the lands I lent her to be equally divided amongst ALL my children according to quantity and Quality INCLUDIND my youngest DAUGHTER ELAN as well as my above named children. Dulany Daughter: Elan (this one may be by Rebecca) The wording implies to me that Daniel, Polly and Elizabeth are somewhat different than Elan. Also the daughter, Elizabeth, probably named for the wife Elizabeth Carey in the Onslow list of marriages(see my post #1345). Also the list of marriages show a marriage of a Polly Cary to Henry Howard, Jr Dec.15, 1830. ______________________________________________ Will of Jephthah Cary written May 17, 1835 Proved May court term 1840 (Jephthah, son of Thomas Cary will of 1812 see post #1372. Wife: Elizabeth Children: Vasta and Zadoe (seems to be under 21) A Vasti Cary married William Hill Henderson on Nov 5, 1844 in Onslow County, N. C. --all my estate both personal and real to wife during her natural life or widowhood. If she should marry I will that the whole of my estate shalle be taken out of her possession and converted to the use and benifit of my son and daughter, Vasta and Zadoc. All my land & one bed & furniture to my son Jabod and the ballance & residue of my estate to my daughter Vasta. So long as my wife remains a widow, she is to have quiet possession of my estate unless my son Zadoc should arrive at the age of 21 before her death or marriage of his mother and should want I wish him to have 1/2 my land layed off to him in absence of the building which I wish his mother to have possession of---i wish my wife Elizabeth shall have the guardianship of my son and daughter----and at her death or marriage I wish my executor to divide my property between my son and daughter---.
