Will witnessed by:
George Lester, Wyatt Bulloch, Dicy O'Kelly
Will of John Carter, Sept. 1838, Oglethorpe Co. GA
In the name of God, Amen. I, John Carter, of the State of Georgia, Oglethorpe County, being sick and weak in body, but of perfect mind and memory, thanks be given unto God. Calling unto mind the mortality of my body, amd knowing that it is appointed for all men once to die, do make and ordain this my last will and testament, that is to say, principally and first of all. I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in decent Christian burial at the direction of my executors, nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly estate wherewith it has pleased God to bless me in this life, I give and demise and dispose of the same in the following manner and form -
First, I give and bequeath to my wife Amelia Carter, during her life time or widowhood, the tract of land I live on, to choose as much of the plantation yearly as she may want and where she want, the balance left of the plantation to be rented out by my executors, and the money arising from the rent to be applied to the keeping up and repairing said plantation, if necessary. Also one bed, bedstead, and furniture, one table and cupboard, sideboard, sitting chairs, and as much of the household and kitchen furniture as she may choose, as many of the plantation tools as she may
choose, also my carriage and gray horse, two choice cows and calves, one sow and shoats and as many of my hogs as will make her meat next year, two ewes out of my stock of sheep, corn fodder, wheat, oats, one hundred dollars in cash, one Negroe man, Jacob, and girl, Judy. Also three hundred and fifty dollars loaned out and note payable to me, which was her own money, and all the furniture and articles she brought here as own. Also the bed furniture she has made since she came here.
2nd: I give and bequeath to Wylie Carter one hundred dollars.
3rd: I give and bequeath to Paul Carter one hundred dollars.
4th: I give and bequeath to Magnus Carter one hundred dollars.
5th: I give and bequeath to William Carter, my son-in-law, one hundred dollars.
6th: I give and bequeath to James Pinson, my son-in-law, fifty dollars. I have previous to this given him fifty dollars.
7th: Thomas Carter, my son-in-law, is not entitled, as I have paid previous to this, to my daughter Hixey, the hundred dollars. If any money left after the pay of the hundred each to make them equal, it is to be equally divided between my legatees.
8th: The balance of my property not specially bequeathed, both real and personal, the Negroes Jack, Simon, Charles, Tilda, Cherry, Clary, Carroline, Elender, I desire my legatees equally divide them among themselves with a sale if they can. The two lots in Cherokee County and one in Lee County to be equally divided between them. The balance of my stock, household, and kitchen furniture, plantation tools, cotton gin and thrasher, blacksmith tools, to be equally divided amongst them. The land and Negroes bequeathed to my wife during her lifetime or widowhood, after her death or intermarriage, the property to be equally divided amongst my legatees.
9th: I constitute, make, and ordain Amelia Carter, Wylie Carter, and Paul Carter the sole executors of this, my last will and testament, and I do hereby utterly disallow, revoke, and disannul all and every other former testaments, wills, legacies bequeathed, ratifying and confirming this and no other to be my last will and testament, in witness whereof I have hereunto set my hand and seal this twentieth day of March, one thousand eight hundred and thirty-eight.

"Polly" was a common nickname for Mary much as "Peggy" was a common
nickname for Margaret.
It has been widely reported that Mary "Polly" Stevens was the first
wife of John A. Carter, and presumably the mother of his children, but
I have not yet seen any historical source documentation to support this.
If anyone can direct me to historical source documentation, such as a
date of death for Mary "Polly" Stevens-Carter, please leave a Post-em.

The Herrings of Winterborne Herringston in Dorset are a noble English family, going back to the Norman invasion in 1066. John Russell, the first earl of bedford (1485-1555), was a great-grandson of Elizabeth Herring of Winterborne Herring. John Russel an ambassador, knight of the garter, and privy councillor to King Henry VIII. John is also an ancestor of Lady Diana Spencer, Prime Minister Winston Churchill, and Prince Charles. It would indeed be great if we any of the present-day Herring's could establish a link back to these folks -- prehaps genertically.

Also, we may also (or alternatively) be related to the equally noble and fascinating Heron/Heyron/Haroun/Harang family, of Ford Castle and Chipchase Castle in Northumberland and Addscombe Mansion in Croydon (south of London), who were exceedingly wealthy and in the royal service for hundreds of years. They spring up in so many historical contexts that it is mind blowing -- the Norman invasion, the signing of the Magna Carta, Battle of Towton, and they were Border Reivers (raiding Scotland) with the Washington family (yes, that one, George's ancestor's). Various of them were Sherifs of various Counties and Castles (e.g., Bamburgh), Keepers of the Tower of London and Crown Jewels, one was the Treasurer of the Privy Council (King's Chamber) for Henry VII and VIII, one presided at the trial of Anne Boylen, One was hung, drawn and quartered for high teason and made a martry of the Catholic Church (for supporting the Carthusian Charterhous monks), one was the son-in-law of Sir Thomas More (a Saint), and on and on.

Notes for Mary "Nancy" (NOT Kilpatrick) Carter:
Most likely, the Thomas Carter who married Mary Kilpatrick was NOT the same Thomas Carter who left the Will in Mecklenburg County, Virginia in 1796.
---
The Thomas Carter who married Mary Kilpatrick/Killypatrick may have been the uncle of the Thomas Carter who left the Will in Mecklenburg County.
According to some reports, the Will of Thomas Carter says his wife was named Nancy. Other reports list the name of his wife as Mary. I think the Nancy was a transcription error. I think the name "Mary" was
incorrectly transcribed as "Nancy" and the error got propagated.

Notes for Margaret Waggener:
From the various records it appears that Margaret was the 4th or 5th oldest child born to her parents John and Rachel Ward. I have estimated that she must have been born between 1675 and 1680. She is listed in the wills of both her parents as being the wife of William Allen. I don't know when she died, but she was reportedly alive at the time of the death of their son Wiliam Jr. in 1739.

There have been reports of a Christening record with the date of 5 Aug 1683 in the Christ Church Parish in Middlesex County, Virginia of a Thomas Carter born to William Carter and Penelope Pew-Carter.
However... I do not believe that Thomas Carter of Middlesex is our Thomas Carter of Goochland. It seems that the Thomas Carter of Middlesex married a woman named Susanna and had a daughter named Penelope Carter in 1712.
According to Peyton Carter, Thomas Carter was married three times.

Settling in the British North American Colonies
From Benjamin Franklin, who wrote in 1751: “So vast is the Territory of North America that it will require many Ages to settle it fully and, till it is fully settled, Labour will never be cheap here, where no Man continues long a Labourer for others, but gets a Plantation of his own”.

In the 1700s the British colonies in America grew rapidly in population and wealth. A former, somewhat crude, society acquired an elite that was somewhat polished and numerous. Trade and cities flourished. The 250,000 settlers who had lived in the newly formed mainland colonies in 1700, became 1,500,000 by 1750 and 2,250,000 by 1775, only 25 years later.

Perhaps it is difficult to comprehend the times and events occurring in the very middle of the 18th century. George II was king of England, Scotland & Ireland, and was Hanoverian (German) in origin. In Europe, the waltz was becoming its most popular dance, and the first golf club, in Edinburgh, Scotland, was just 6 years old. In the colonies, the 5 major centers of affluence were Boston, New York, Philadelphia, Charleston, and Newport. The elite wore wigs, and slavery was an important part of the economy. The city of Richmond, Virginia was started in 1737, while Charlotte, North Carolina was just being settled in 1750. Benjamin Franklin was working on his lightning conductor. The Ohio River and Tennessee were just beginning to be explored. The beginnings of the American Revolution, the conflict where the colonists won their independence from Great Britain, were still 13 years away. George Washington was 18 years old, and Thomas Jefferson -- seven. The birth of the United States of America was 26 years away.

# Note:
EDWARD WARD was born circa 1660 in Henrico County, Virginia and died about 1712 in Craven County, North Carolina. He married ELIZABETH ELAM, daughter of GILBERT ELAM, some time before 1690 in Henrico County, Virginia. They had five children: ENOCH WARD, EDWARD WARD, SARAH WARD, JOHN WARD, & ELIZABETH WARD. His brother, CAPTAIN SETH WARD, died in 1707. His brother, RICHARD WARD, survived him; it is not known what became of his sister, ELIZABETH WARD. His wife ELIZABETH ELAM died August 3, 1713 in North Carolina.

EDWARD WARD was the youngest son of RICHARD WARD, as proved by said RICHARD's Last Will & Testament dated 18 April 1682 and proven August 1682 at Henrico County. The following bequests were made to EDWARD WARD by his father, RICHARD WARD"

[ From Family History: Virginia Genealogies # 2, 1600s-1800s, CD #186, pp 359-361]

ROSSE, an Indian boy, belonging to EDWARD WARD (who was formerly sold by Mr. RICHARD WARD decd at ye Outcry made of ye estate of Captain JOHN KNOWLES decd] being brought by SETH WARD before this Worshipful Court is adjuged to be fifteen years old. [Henrico Record Book 2, 1678-1693, page 120, Magazine of VA Genealogy, Vol 30, No 2.]

April 1691 a patent was granted Gilbert Elam Sr, Gilbert Elam Jr, & Edward Ward for 1015 acres of land on Fallen (Falling) Creek, Varina Parish, Henrico County. (Register of the Land Office, Patent Bk 8, p 147).
GILBERT ELAM, SR. of Henrico County in his will dated Feb 17, 1693/4 & probated June 1,1696 mentions (among others) son-in-law, EDWARD WARD.

January 28, 1692/3: EDWARD WARD of Varina Parish, Henrico Couny conveyed to SETH WARD of same parish, planter, 150 ac on south side of James River, Henrico Co., bounded by the river and ye old footpath that goes up Falling Creek, to a white oak near ye Woolf pit, upper end of ye bounds that was between ye said EDWARD WARD & SETH WARD (Ibid, 1688-97, p 382).

January 28, 1692/3: SETH WARD, of Varina Parish, Henrico Co., conveyed to EDWARD WARD of same parish & county, planter, 150 acres on south side of James River, Varina parish, Henrico, bounded on Seth Ward's land ye lower side, and ye upper side binding upon Richard Ward, the lower side b ounding upon ye river; line of markt trees formerly markt by my father; ye left hand of ye foot path as goes into ye Kings Hwy by ye Spring run side; ye hill of Falling Creek (ibid Vol 1688-97, p 383).

August 1, 1702, EDWARD WARD of Henrico, conveyed to WM. SOANE of Henrico for 1430 lbs of tobacco, 150 acres in Henrico on north side of Falling Creek, being part of 2015 acres formerly taken up and patented by GILBERT ELAM SR. & JR, and said EDWARD WARD. (Henrico Records, Vol 1697-1704, p 291).

October 1, 1704, EDWARD WARD, of Henrico Co, planter conveyed to Robert Bolling Sr. of Prince George County for 6700 lbs of tobacco, 150 acres in Henrico Co., on south side of James River, adjoining SETH WARD, RICHARD WARD, trees formerly marked by my father. (Ibid, Vol 1697-1704, p 493).

July 1708 CAPTAIN SETH WARD was the only Ward living in Henrico County when HENRY LOUND made his will naming granddaughter, ANN WARD. He could have been the only Ward married to Ann for Captain Seth Ward's brothers at the time were already married: Richard Ward to Elizabeth Blackman; Edward Ward to a daugher of Gilbert Elam. It is believed that Ann, Captain Seth Ward's widow, married 2ndly William Blackman. [Source: Genealogies of Virginia Families, Volume V, Ward Family, p 366]

December 1707, WILLIAM BLACKMAN having by his petition to the Henrico Court set forth that Edward Ward by his misrepresentation obtained an order at last court for laying open a road which leads through plantation whereon he (petitioner) lives belonging to the orphans of SETH WARD, decd. (Henrico Court, Order Bk 1707-09, p 11)

April 1708, Mr. SETH WARD, 3 days evidence in difference between WILLIAM BLACKMAN & EDWARD WARD (Ibid, 1707-09, p 30).

April 1708 JOHN CLARK gave evidence in behalf of RICHARD WARD in difference depeding betweeen WILLIAM BLACKMAN & EDWARD WARD concerning stopping of a road (Ibid, p 32). The Richard Ward mentioned in his order is evidently Richard, son of Captain Seth Ward, and eldest of the minor orphans whose property was in Blackman's hands.

April 1708: Order for road granted EDWARD WARD through plantation whereon he now lives belonging to orphans of SETH WARD decd is reversed. (Ibid, pe 33).

May 1708 In record of a suit in Henrico County: "EDWARD WARD being privately deparated out of this county indebted to ROBERT BOLLING & Company." (Ibid, Order Book 1707-09, p 39. And with this mention Edward Ward disappeared from the records of Henrico County, VA. From the above records it would indicate that EDWARD WARD had problems with his sister-in-law, Ann Hatcher's second husband, WILLIAM BLACKMAN. Also he had financial problems relative to Robert Bolling and Company. He later appeared in the records of Craven County, North Carolina. In 1708/09 he witnessed a deed in Beaufort County, NC. It appears that EDWARD WARD quietly departed Henrico County in May 1708 and removed to North Carolina.

275       i.       Elizabeth Elam, born Abt. 1675 in Henrico Co., Virginia; died 03 Aug 1713 in Craven Co., NC; married Edward Ward WFT Est. 1689-1708.
       584. John Langston, born 1620 in Brewerton, Cheshire, England; died 1694 in New Kent, Virginia. He was the son of 1168. Henry Langston and 1169. Elizabeth Worrell. He married 585. Katherine Mulford or Mountford Abt. 1645 in Nansemond, Virginia.
       585. Katherine Mulford or Mountford, born Abt. 1620; died 1699 in New Kent, Virginia.
Notes for John Langston:
Immigrant. John is found in immigrantion records of first 20,000 early immigrants compiled from patent books, etc. He arrived 1635. He would have been about 15 years of age. The name of his ship is not known.
Found in records of New Kent, Virginia
'A little later a John Langston was resident in the same county, New Kent. He took the side of Bacon in his Rebellion, and by act of Assembly June 1680, was disqualified from ever holding office. He had been elected a Burgess for New Kent this Assembly, but was not allowed to take his seat. In 1704 the name does not appear among the landholders of New Kent or the counties formed from it, but it is possible that John Langston had a daughter or daughters, as Langston appears later as a baptismal name in several New Kent families. John Langston had two grants of land. The first, 1681, to 'John Langston" for 1300 acres in New Kent, being the land formerly granted to Hannah Clarke, found to escheat by Marke Workman, Deputy Escheator, and now granted to John Langston. The other to "Mr .John Langston" Sept, 18, 1681 for 1316 acres in New Kent, adjoining the lands of Sir Philip Honeywood, the river, land patented by Moses Davis, and of John Fleming, Thomas Glass, James Turner, being the land formerly granted to Mrs. Hannah Clark and found to escheat.
There was a group of loyalists in this section. Sir Phillip Honeywood, Col. Mainwaring Mammond and Anthony Langston had been loyalist officers, as had been William Bassett of the same county. Mrs. Hannah Clarke was widow of John Clarke of York County who was a son of Sir John Clarke, of Wrotham, Kent, England. She was also the executrix of Sir Dibley Wyatt, a Royalist officer, who died inVirginia in 1651 and was n doubt either his daughter or widow."
