24 Feb 1708/09. McCarty vs. Spencer p. Carney. Judgment is granted Daniel McCarty against the estate of John Spencer, Gent., deceased, in the hands of Thomas Carney, who intermarried with Mary, the relict and executrix of John Spencer, for 870 pounds of tobacco. Ordered sd Carney to pay the same to said McCarty together with costs &c. als execution. Westmoreland County, Virginia, Order Book, 1705-1721, page 116a. 30 Jun 1709. Wright vs. Carney. Francis Wright, Gent., brought attachment against Thomas Carney for 700 pounds of tobacco and the Sheriff returned he had attached what of the said Carney's estate should appear to be in the hands of Dominick Newgent, and had summoned him, &c., and said Dominick being examined upon oath declared he had none of Thomas Carney's estate in his hands (excepting an old book), whereupon the attachment is dismissed. John Wright, attorney of Joseph Belfield obtained an attachment against the estate of Thomas Carney for 457 pounds of tobacco and the Sheriff returned he had attached as much of the said Carney's estate as amounted upon lawful appraisement to 195 pounds of tobacco, the debt appearing to be justly due, Judgment is granted Joseph Belfield for the goods so as by the Sheriff attached and it is ordered that he deliver the same to said Joseph or order, &c., part of his debt. Judgment is granted Thomas Newton against Thomas Carney for 500 pounds of tobacco attached on a parcel of sd Carney's estate valued at 650 pounds of tobacco and the sd. Newton haveing proved his debt by his oath, ordered he be paid the same out of the estate so as attached together with costs in this behalf is so much remaines after his debt is paid. Judgment is granted Francis Spencer against the estate of Thomas Carney for 50 shillings sterling attached by the Sheriff on an old horse valued at 500 pounds of tobacco. And said Spencer haveing made this debt appear, it is ordered he be paid the same out of the estate so as before attached together with costs in this behalf is so much there be &c. Westmoreland County, Virginia, Order Book, 1705-1721, page 127. 22 Feb 1709/10. Dr. Carney vs. Lynch's Admr. Account approved. Doctor John Carney produced an account of his against the estate of Francis Lynch, Mercht., deced, and made oath the same was a just and true account and that he had not received any satisfaction for the same or any part thereof. Francis Wright, Gent., brought his action against Thomas Carney for 500 pounds of tobacco and the defendant failed to appear. The Sheriff having returned non est inventus, upon motion of the plaintiff an attachment is granted him against the defendant's estate. Westmoreland County, Virginia, Order Book, 1709-1711, page 147. 25 Apr 1711. Present Joseph Bayley, Gentleman, Justice, &c. Carney vs. Spencer. Upon the petition of Mary Carney, it is ordered the Sheriff of this county do summon Francis Spencer to appear at next court held for this county to answer Mary Carney's petition against him for dower of 900 acres of land in the county of Westmoreland and Parish of Cople. John Carney brought suit against Robert Allweathers for 800 pounds of tobacco by account but for that he failed to prosecute the same, upon motion of the defendant a nonsuit is granted him and it is ordered John Carney do pay him 5 shillings for his unjust molestation together with costs als execution. Westmoreland County, Virginia, Order Book, 1705-1721, page 156a. 26 Sep 1711. Spencer's Guardian Ashton. The petition of Mary Carney, wife and attorney of Timothy Carney, and late wife of John Spencer, Gent., deceased, praying guardianship of Frances Spencer, daughter of John and Mary [who is now in the custody of Francis Spencer, her Uncle who by law is not qualified to keep her], being heard and maturely considered by the court it is their opinion Francis Spencer ought not keep and detain Francis, his cousin, and thereupon they do order by and with the consent of Mary Carney that Henry Ashton, Gent., have the tuition and guardianship of Frances Spencer for whom he became surety at her baptism and it is further ordered Frances Spencer do deliver his cousin into the custody and care of Henry Ashton or order without delay.
