THE CASE of EDWARD F. HUNTER -- The Sacramento 'Bee' of Saturday has an account of the shooting and killing of James KENNEDY, in that place, at 1 o'clock on Saturday morning. From what evidence the 'Bee' prints it does not appear that deceased gave any provocation for the killing. HUNTER is an attorney from Sonora, and was engaged as counsel in the DAVIS-KEIGER murder case. He was on his way to Marysville, where the habeas corpus which he had issued in KEIGER's favor was to be heard; but by killing KENNEDY he places himself in a position similar to that of his client. The 'Bee' gives the following statement as to the homicide:
Officer MARTZ, who arrested HUNTER, tells us that at 1 o'clock last night, he passed the corner referred to, and saw 4 young men standing together and talking. Their names were MERKER, FAYLOR, BOTTS and KENNEDY. He passed them and proceeded up the east side of Second street, and when opposite the Verandah (liquor saloon), heard the sharp report of a pistol. The officer immediately turned back, and on reaching the corner, saw the body of a dead man stretched across the sidewalk, and a man standing at the
feet looking at the corpse. The body was at once recognized as that of KENNEDY, whose 3 companions had fled rapidly up K street. On hearing the discharge of the pistol, several persons came over from the Bank Exchange. Officer MARTZ made the remark, 'Can no one tell me who shot this man'' To which HUNTER coolly replied, 'I did, sir.' MARTZ said, 'Then I arrest you -- give me your pistol.' HUNTER hesitated about giving up his weapon, whereupon the officer put his hand behind his (HUNTER's) back and drew out one of Colt's improved pistols of latest patent and small size. By this weapon KENNEDY had been killed. HUNTER was taken to the police office, and on arriving there he was asked if he had any more weapons about him. He said that he was supplied with plenty of irons and drew from his left breast a 6-shooter. He said that a man had struck him once and was attempting to do so a 2nd time, when self defense compelled him to kill his assailant.
