MILLBURN was intoxicated, armed himself with a pistol and slung-shot, and made an attack on PEPARD, whose head was bruised and beat in a shocking manner. At length PEPARD discharged a pistol at MILLBURN, the shot taking effect in his abdomen, and causing death the next day. The wounds on PEPARD's head are not mortal.
