Hello again, my fellow BURTON rooters. Someone this past week expressed to me some confusion about these two men, who were born in the Wayne/Pulaski Co, KY area. I thought I would share with the group what I have accumulated on the two men, and offer you the opportunity to comment.

September Court 1817
On the motion of Elizabeth Burton, Alexander West, and James Roberts. Now administration of the estate of William Burton deceased is granted to them whereupon they took the oath required by law and executed and acknowledged bond in the sum of $1,000. Conditioned as the law directs with Joseph Bond and James McKinley their securities.
Ordered that John Dibrel, Nathaniel Shrewsbury, Joseph Richardson and Barksdale Snider or any three of them to appraise the Wares if any and personal estate of which William Burton died siezed and possessed of and that they report specially to this court.
On the motion of William Barnes, Sheriff of this county, Julian Oatts and Andrew M Stone are administers (sp?) his (deposition??) whereupon they took several oaths required by law.

5/2/1833: Know all men by these presents that we Peter Johnson and James R. Burton are held and firmly bound unto the Commonwealth of Kentucky in the sum of $50 current money the payment of which to be made good we bind ourselves, our heirs. Sealed and dated the 2nd day of May 1833. The condition of this obligation is such that if there should be no lawful course to obstruct the intended marriage of Peter Johnson and Emely Burton, then the obligation to be void else to remain in full force.Peter Johnson

BURTON on the same day that he died to witness said will, which is as follows (To wit)
I give and bequeath unto my wife JERUSHA BURTON all the tract of land where on I now live accept fifty (50) acres at the Little Spring as aforesd. I give and bequeath unto my sone WILLIAM and the ballence of my Estate is to be equally divided amongst my children only my son WILLIAM is to have no more of the land than what I have alotted to him as aforesd given under our hands this 23 day of September 1814 -

Burton on the same day that he died to witness said Will which is as follows: towit: I give and bequeath unto my wife Jerusha Burton all the tract of land whereon I now live during my lifetime, we being the heirs of Thomas Burton, deceased, of the first part and George B. Burton of the second part .
Comes now William T. Burton, guardian of the persons and ., property of James R. Burton, Susannah Burton and Jerusha Burton in part heirs of Thomas Burton, deceased, and represents that they are the owners of said tract or parcel of land containing 165 acres of land, be it more or, less, as heirs of their deceased father and her husband, that the said land cannot be divided so as to be beneficial to said heirs and mother, therefor the said Mother and. heirs doth authorize the said William T. Burton to sell the above tract of land on a credit of twelve months (to the highest bidder) the purchaser by giving bond and security to the satisfaction of said Burton, and George S. Burton was the purchaser of the said land, it lying and being in Pulaski County in the State of Kentucky.
