Will of Henry Budd - 29 March,1809, White Plains, New York

I, Henry Budd of the Town of White Plains in the County of Westchester do this twenty ninth day of March in the year of our Lord One Thousand eight hundred and nine make this as and for my last Will and Testament in manner and form following:
First, I give and bequeath to my loving wife Gloryana at her disposal forever two of my best beds, bedding, and furniture compleat one cherry table, one looking glass, one Clothe Cubbard, six of my first quality and six of my second quality setting tchairs, one half of all my linen, one pair brass head Andirons and shovel and Tongs, her hunting saddle and so much of my Kitchen furniture as will furnish her with materials to use in keeping house in a comfortable way.
Secondly, I will and order my Executors hereinafter named, or such of them as shall qualify and undertake the execution of this m Will to sell all the remainder of my personal Estate and also to sell all my real Estate at some convenient time as to them shall appear most beneficial to my Estate and the Legatees after named and out of the money so raised to pay all my just debts and funeral charges and the charges of settling my Estate and the remainder of the money in my Executors hands I do give and bequeath in the following manner.
First I give and bequeath to my said loving wife Gloryanna at her disposal forever all the one seventh part of the money in my Executors hands after they have paid as above directed.
Second, I give and bequeath to my son Joseph and to his Heirs and Assigns forever the Sum of One Hundred and twenty five dollars upon condition that he will not call on my Executors for payment of any sums of money for his labour for me since he arrived to the age of twenty one years.
Thirdly, and all the remainder of such money I give and bequeath in the following manner, that is to pay for my sons Joseph, Henry, Benjamin, Gilbert, and Jonathan and to my daughters Mary Haight, Elizabeth, Deborah, Tamar, and Sarah severally and to their several respective Heirs and Assigns forever to be divided in the following manner, that is to say to my Sons Joseph, Henry, Gilbert, and Jonathan and to each of them the sum of Ten Dollars, and to Mary, Elizabeth, Deborah, Tamar, and Sarah and my son Benjamin and to each of them the sum fo Five Dollars and in that proportion.
I will and order my executors to pay of such money to my said children until the whole of such money shall be paid out excepting as to my daughter Mary Haight out of her proportion I order to be deducted the sum of Two hundred and twenty five Dollars being so much money I have advanced for Articles and before given to her which sum I order to be divided as the other money is ordered to be divided.
Fourthly, I Will and order my Executors to put all the proportions of money given to my Sons under the age of Twenty one years at Interest, and all the proportions of money given to my daughters under the age of eighteen also at Interest and to pay the Interest that arises thereon severally for the support, maintenance, clothing and education of such children from time to time at their discretion and pay to my Sons their several proportions both principal and Interest in their hand as they severally shall be twenty one years old and in like manner pay to my several daughters as they severally shall be eighteen years old or at their several marriage day or days if that shall take place before they or either of them shall be eighteen years old.
Fifthly, I do hereby constitute and appoint all my Executors that shall qualify and underake the Execution of this my Will trustees for my two sons Gilbert and Jonathan during their minority and I do authorize and empower the said Trustees as Trustees and Guardians for my said two sons to take their persons and property into their possession and by Indenture or Indentures to bind them Apprentices to some person or persons to learn some mechanical art or arts if they shall think it advisable and for the benefit of my said Sons or if it should be found to be more for the benefit of my said Sons or either of them that the said Trustees and Guardians shall contract with some person or persons to teach my sons or either of them some Mechanical Art of Arts and in such contract such Trustees and Guardians ought to give a sum of money for that purpose. In such case I authorize and empower the said Trustees and Guardians to contract and to give such sum or sums of money out of the proportion of such sons contracted for as they shall think reasonable and adequate for the purpose and further to do and perform every other act or thing toward my said two sons as I could might or ought to do if I was living. And in case either or both of my Sons shall refuse to comply with and perform the Covenants made and entered into by such contract I in such case Will and order that their Trustees and Guardians out of their several proportions retain in their hands such sum or sums of money as they shall be compelled to pay for on account of such nonperformance of such covenants.
Lastly, I nominate and appoint my said loving wife Gloryana, my son Henry Budd, and my trusty friend Israel Mott, and Elijah Purdy. Junior Executors of this my last Will and Testament
In testimony whereof I have hereunto set my hand and seal the day and year first above written. Henry Budd (LS)
Signed sealed pronounced and declared by the said Henry Budd this to be as and for his last Will and Testament in the presence of us called in by him to be Witnesses to the same.

Westchester County: Be it remembered that on the Twenty first day of December in the year of our Lord One thousand eight hundred and thirteen personally appeared before me Samuel Youngs, Esquire, Surrogate of the County of Westchester, Josiah Carpenter, John Budd, and David Angevine who being duly sworn on their Oaths declared that they did see Henry Budd sign and Seal the preceding written instrument purporting to be the Will of the said Henry Budd bearing date the Twenty ninth day of March in the year of our Lord One thousand eight hundred and nine and heard him publish and declare the same as and for his last Will and Testament; that at the time thereof he the said Henry Budd was of sound disposing mind and memory to the best of the knowledge and belief of them the deponents; and the said Deponents severally subscribed the said Will as Witnesses thereto in presents of the Testator.
