In the name of god Amen the v th day of July in the yeare of our Lord god one thousand sixe hundred twentie and foure I Hugh Brindley of Hixton in the Countie of Stafford husbandman being at this present time of reasonable health of bodie and of sound and perfect memorie praysed be god knowinge the certaintie [of] death to all humaine creatures and the uncertaintie of the tyme thereof therefore willinge and desirous to put in order to the glor[i]e of god the good of my children and my owne content all such worldy substance as god of his greate goodnesse hath blessed one withall doe ordaine and make this my last will and testament in manner and forme following. Sume of Money for the person or persons of my said Younger Children as I should by my last Will and Testament direct and Appoint Item my Will and mind is the said James Lunn and James Brindly or the Survivor of them or the Excrs or Admrs. of the Survivor of them doe and shall Imediately after my Decease and the Decease of Mary my now wife raise the said Summe of One Hundred {Pounds} and Sixty pounds of Lawfull money out of all or any of the said last mentioned premisses as aforesaid and with the money soe raised pay and discharge my debts which I shall owe att the time of my Decease and wch. shall not be paid and satisfied by the said Paul Smith and James Brindly and the Survivor of them by the Excrs. or Admrs. of the Survivor of them and th {over} overplus of the said Money If any shall be I give and devise of the same to and amongst all my Younger Children share and share alike And as for and concerning all my Goods Chattell and Chattells withindoors and without Quick and dead of what Kind or nature the same be or wheresover the same may be or can be found I give and dispose of the same unto the said Paul Smith and James Brindly their Excrs. The fourth day of November in the yeare of our Lord god 1667 I Richard Bryndley of Hixton in the Countie of Stafford yeoman beinge at this present tyme sicke in body but in sound and perfect memorie praysed be god. And knowinge the certayntie of death to all mankinde and the uncertayntie of the tyme am therefore willinge and desirous to the glory of god and my owne content to putt in order all such goods as god of his goodnesse hath blessed me withall I doe therefore ordayne and make this my last Will and testament in manner and forme followinge. First I commend and comitt my soule unto almightie god my creator and to Jesus Christ my blessed redeemer by whose meritts I trust to be saved and to enter amoge the pleasures of gods kingdome for evermore And my body to the earth from whence yt came. And for my temporall goods I dispose of as followeth. First my mynde and will is to be honestly and devoutly brought home & my funerall expences discharged and my debts to be payd out of the whole of my goods. Item I give and bequeath unto Richard Browne sonne of George Browne of Hixton deceased the sume of tenn pounds: besydes tenn pounds which I owe unto him being a legacie given unto him by his grandfather Richard Bryndley. Item I give and bequeath unto Elizabeth Browne daughter of the said George Browne tenn pounds besydes tenn pounds which I owe unto her beinge a legacie given unto her by her grandfather Richard Bryndley. Item I give and bequeath unto George Browne sonne of the sayd George Browne Seaven[?] pounds. Item I give and bequeath unto Thomas Browne sonne of the sayd George Browne Seaven[?] pounds. Item I give and bequeath unto my brother in law Edward Woode fyve pounds. Item to Edward Wood the younger fyve pounds. Item I give and bequeath unto Anne Shelley my servant mayd five pounds, one whyte fynched heyfer, one bedde in the parlour whereon she useth to lye the bedestides with the furniture belonginge to the bedd two payre of sheets, the one payre flaxen the other payre hempton. Item I give and bequeath unto John Wilson my servant man fourtie shillings Item I give and bequeath unto my cosen John Bryndley of Brocton tenn pounds. Item I give and bequeath unto the sayd Elizabeth Browne the bedde in the [ ] whereon I use to lye with the furniture belonginge to it, two payre of hempton sheets, a table cloath, a towell, halfe a dozen of course napkins, one presse in the parlour and 2 pewter dishes. Item to my sister Isabell Woode one hundred weight of cheese, three payre of sheets, 2 payre of hempton, one payre of flaxen. Item I give unto the sayd Richard Browne the table in the house, the cubboard, the dishborde and two bedes in the high chamber Item to my cosen Ellenor Hyndley tenn shillings. Item to Emme Tunnicliffe five shillings. Item to Edward Meredith five shillings. Item to Jane Baddaley[?] two shillings sixe pence. Item to Thomas Wyley[?] {five} 2 shillings sixe pence. Item to my sister Isabell Woode my bigge [?]yde cowe. This is a short account of some particulers that Thomas Brinley Late of Brockton in the parish of Berkewitch declared to his mother in law Jone Brinley a little Before his decease in manner and forme as followeth. Viz. hee said that whereas Hee had 16 nephews and Neces His meaning and Intention was that it Being that his father Walter Brinley deceased did Bequeath By his last will and testament to Each of the abovesaid Nephews and Neces to Every of them five pounds a peece Now the said Thomas Brinley Being His fathers executor and was ordered By his said father to pay them severally at such time as they should Come to lawfull age to give an acquittance Hee then said to his said mother in law that the said five pounds should Bee made up to Every of the abovesaid 16 to Every of them 20 a peece to be paid by his Executors as abovesaid when any of thay 16 shall severally Come to lawfull age to give the said executors a genneral acquittance Hee also declared that his tow Brothers John Brinley and Walter should bee His lawful executors Hee said also that his servant Hennery Finley {should} should have that shoott of uparell that {was} then was upon his back at his decease and also tenne shillings of money And to every of his other servants each of them 5s. a peece. Joan Brinley [signed]. The said Jone Brindley being aged and weak altogether unable to travel whereby to make affidavit Hereof but declared all the abovesaid to us whose names ar subscribed Jo. Wallther; Will. Abarne; William Hasoferfeney; Thos. Byrch; the mark of Jone Phillips
