Vern D /////////////////////////////////// Transcribed by D Sardoc /////////////////////////////// Stockton Daily Argus Stockton, San Joaquin Co., CA 1-5 January 1861 ************************* >>Friday, 4 Jan 1861<< KILLING in SACRAMENTO -- The Wrong Man Shot -- On New Year's morning in Sacramento, Dr. J.R. BOYCE, a respected citizen of Sacramento, was shot by William TIERNEY. TIERNEY had been living at Washoe, and had become convinced on his return to Sacramento that a man named John H. CASSIDY had seduced his wife. Dr. BOYCE and CASSIDY were walking together, when TIERNY [spelled 2 ways], seeing CASSIDY, shot at him, but missed and hit Dr. BOYCE, the pass passing between the shoulders and coming out in front through the chest. The 'Bee' says CASSIDY, on hearing the shot, started like a deer and was followed by TIERNEY, who fired 3 more shots at him, but they all missed their mark. The fugitive took refuge in the Railroad Exchange, after running 3 blocks, and seemed almost terrified to death. Soon after the shooting, TIERNEY was promptly arrested by officer TAYLOR and taken to the Station House. At the request of Dr. BOYCE, the prisoner was brought to his bedside for the purpose of ascertaining if they had met before, but they were strangers to each other. TIERNEY was much affected as he looked on his victim and tears flowed; and holding up his hand he said, "I call God to witness, Dr. BOYCE, that I had no intention of hitting you! I hope you will forgive me; and if you do die -- which God forbid! -- may you die in peace!" Speaking of CASSIDY, however, TIERNEY expressed regret that he had not killed him; and if he had succeeded in that he would consent to being hanged. Notify Administrator about this message?
