WILL OF JOHN BOUSH Written 7/24/1790 Probated 5/28/1792
(Will Book 1 - page 45a-46) Norfolk (City), Va.

In the Name of God. Amen. I John Boush of the Borough of Norfolk and Clerk of the county court of Norfolk being in my perfect senses, do make and ordain this writing as my last will and testament in the following manner. In the first place I desire that all my just debts
may be paid out of my real or personal estate by my executrix and executors or the survivors or survivor of them hereafter named, including my funeral expenses which I desire to be attended with as little cost and pomp as pofsible; And then I give and bequeath unto my
dear and affectionate wife Frances Moseley Boush and to my child she is now pregnant with (whether male or female born alive if a male he arrives to the age of twenty one and if a female to the age of Eighteen years) the whole of my real and personal estate to be equally divided between them and their respective heirs forever, including
what I may be entitled hereafter from my father or Brother's estate. But in case such child should not be born alive or should die before it arrives to the age above mentioned, it's then my desire that the
said estate (after deducting therefrom what I am titled to by my dear wife, which in such case I further give her) should descend to my brother Robert, he paying to my two sisters fifty pounds each for buying a ring &mourning if they think proper, & to his heirs forever.
- But if it should happen that Piney Grove is not paid for before my death, and before the death of my child, that it is my will and desire and I do order it, that the estate devised to my brother, in case of the death of my child at the period abovementioned, should go and be sold to complete the purchase of said plantation; and lastly I do
nominate and appoint my dear wife and James Nimmo esq. my executrix and executor of this my last will and testament. It may appear strange not to appoint my brother an executor, but knowing he is not fond of businefs I would not from this motive and no other in the
world appoint him. In Witnefs whereof I have set my hand and seal this 24th of July 1790.

This codicil is to be taken as part of my will- if it should happen that Piney Grove is not paid for before my death, and knowing that my personal estate is liable for paiment of it, I think it would be for the benefit of my dear wife and child for my executrix and executor to
dispose of as many of my houses and lots in Norfolk Borough as will pay up the balance of the debt owed for Piney Grove therefore I direct that either or both of them may sell and dispose of as many houses and lots as will pay up such balance. witness my hand this 24th day of
July 1790.

(Order of probate dated May 28, 1792)

On 10/22/1792 the Court gave the order to Inventory and appraise the estate of John Boush. His estate in James City County, Va. was appraised 1/1/1793. His estate in Norfolk was appraised 2/21/1793. These inventories and appraisals were returned to the court and recorded 2/25/1793. (Will Book 1 - page 58, 58a and 59)
