I found the Texas inheritance laws a few weeks ago.They are on the University of North Texas website at http://texinfo.library.unt.edu/lawsoftexas/gltv2.htmhttp://texinfo.library.unt.edu/lawsoftexas/gltv2.htm.This is the table of contents page.Click on 4th Congress Republic of Texas, 1840-1841.That will open in Adobe Reader.Then click on Section 2.The page number where the laws begin is page 306.You have to look at the page numbers at the bottom of the page, not the ones on the top of the page.The law says that if a person dies intestate, his estate passes on to his children and their descendants; then goes on to state who the estate will pass on to if there are no children.This law was approved 28 Jan 1840, so it would cover the John Blanton who died intestate in Nov. 1840.If this family followed the law, then Isaac could not have been a child of John since he was not mentioned in the estate.But, I have not found mention of Elisha Blanton in the probate papers that I have either.We copied what I thought were all the papers when we were in Red River County a couple of years ago, but there may be more.I plan to see if we overlooked something the next time I get up there.
