A couple of other thoughts this morning. Yes, it would be good to see an actual copy of Samuel's deposition, not just a transcription. Samuel's brother Thomas did have surviving children, namely Edward and grandson Thomas (s/o Edward's brother Thomas). This grandson Thomas is my main focus of Dunscombe research as his dau Rebecca married Richard Joell.
But I think what Samuel was trying to settle was the inheritance line of his older brother Phillip who had 2 sons: Thomas & Phillip (Thomas being the elder). Both of these sons had sons named Thomas and I suspect Chrisian or Christiana, widow of Phillip's Thomas (who died in the early to mid 1690s), had attempted to get the Jadwyn inheritance for their daughter Ann or Anna. This inhertance was denied by the courts, probably with Samuel's testimony & the later deposition was just supplemental -- in case the inheritance issue ever came up again.
Another point: I have Samuel's wife Abigail's death date as 1687, not 1678. Besides Abigail [b.1654] being too young to be the mother of Samuel's eldest son Thomas, there is the will of Elizabeth Burgess' father:

wife Frances, ch: Anthony, John, Jeremiah, Martha, Mary, Miriam, Sarah, Elizabeth DUNSCOMBE

[I realize this is flimsey evidence that she was Samuel's wife, but I still hold that Samuel did have a wife before Abigail.]
As for Samuel's 3rd wife being Elizabeth Pitt: she was named as wife of Samuel Dunscombe in will [20 Dec 1690]of her sister, Ann Pitt Squire, widow of John Squire Also, I suspect the Christoper Pitt who was witness of Samuel Dunscombe's 1705 will was Elizabeth's father.
It's entirely possible that the only reason Daniel & Susannah were not mentioned in Samuel's will was because he had already settled something on them when they departed Bermuda.
I want to note that I did not receive email notification from GenForum of your answer to my first post. Meaning, I hope you are checking this thread. Perhaps I should have replied to your message on the other Bermuda genealogy website -- that might also have lured others into this discussion.
