Charles Bays/Sarah Stacy Divorce - Carter Co, Ky.

There has been some confusion about the wives of Charles W. Bays. His first wife was Sarah Stacy whom he married on 9 Oct. 1836 in Scott Co., Va. He lived with Sarah for ten years and then he filed for divorce in Carter Co., Ky., in April 1847 stating Sarah left him and was living in adultery with a young man named Baldwin in Cincinnati. In his petition he defined Sarah his wife as Sarah Stacy. This divorce action explains why some descendants/researchers thought Charles had been married to one Sarah Baldwin. It is not known at this time whether Sarah ever married Mr. Baldwin but the Sarah Baldwin of family tradition was clearly Sarah Stacy, the first wife of Charles W. Stacy. This Sarah is not to be confused with Sarah (Hall)Biggs by whom Charles later had one son born out of wedlock named William Riley Bays.

Case was filed April 12, 1847 and continued several times.

Case file contained a Bill of Complaint by complainant Charles Bays and a couple of summons for Sarah Bays, defendant. Return by sheriff stated Sarah was not to be found in the county.

Summary:

Charles Bays filed for divorce from Sarah Bays whom he stated had left him to live in adultery with a young man named Baldwin in Cincinnati. Charles defined his wife Sarah as Sarah Stacy whom he married on or about 1836. He further stated they had lived together until the [blank] day in August 1846. There was no mention of any children.
