Sally Baughan, widow of Littleberry T. Baughan (Grantor) to Jos. Baughan and Charity A, Benjamin Baughan, William Baughan and Sarah, James F. Baughan and Mary E., Sally Ford, widow of Richard Ford, 9/16/1856, Henrico County Deed Book 68, Page 544. Baughan to Baughan This Deed, made this twenty eighth day of May in the year eighteen hundred and fifty six, between Sally Baughan, widow of Littleberry T. Baughan, and Jos. Baughan and Charity A., his wife, Benjamin Baughan and (blank) his wife, William Baughan and Sarah, his wife, James F. Baughan and Mary E. his wife, and Sally Ford, widow of Richard Ford, children and heirs of said Littleberry T. Baughan, all of the County of Henrico. Whereas, the said Littleberry T. Baughan who died intestate in the year 1855 was seized of a tract of land in the upper end of Henrico County whereon he resided containing nearly seventy acres and also of an undivided moity of 21 acres and 21 perches of land purchased jointly with his son, Joseph Baughan from Benj. J. Duval and and (sic) conveyed to them by deed dated October 1st 1851, and Whereas during the life time of said Littleberry T. Baughan, To wit, on the 10th day of February 1844, he conveyed to said Joseph Baughan 25 acres of land, part of the tract whereon he lived, and on the 27th day of the same month conveyed to Benjamin Baughan 25 acres of the same tract, and on the 28th day of the same month conveyed to William Baughan 25 acres also part of said tract which several deeds were admitted to record in the Office of the Clerk of Henrico County on the 5th day of March 1844. And Whereas, it is the wish of all of the above named parties, heirs of said Littleberry T. Baughan, to have a final and equitable division of all the lands of said estate and Whereas, the said Joseph, Benjamin and William Baughan do not wish to avail themselves of any advantage which might accrue to them in consequence of their father, the said Littleberry having died intestate but are willing and desirous that the lands conveyed to them by the said Littleberry should return back to the estate for an equal division of the whole estate among all the heirs or be considered as part of their distribution portions and Whereas the parties to this deed have caused a survey to be made of said estate and dividing lines to be run giving to the several legatees portions of land satisfactory as well to themselves as also to the other legatees a plot of which survey is hereto annexed and made a part of this deed. Now Wherefore (this) deed, Witnesseth that in consideration of the promises the said Sally Baughan, Benjamin Baughan, William Baughan, James F. Baughan and Sally ford, hereby convey to the said Joseph Baughan all their right, title and interest in and to the piece of ground containing 10 acres, 2 roods and 33 perches of land designated by the letter C, on said plot, it being one moiety, it being one moiety (sic) of the land purchased jointly with said Littleberry T. Baughan from B. J. Duval, also lot numbered one (1) on said plot containing 28 acres, 1 rood, and 24 perches, also lot No. 3 of said plot containing 28 acres 1 rood and 24 perches, of which lot 25 acres were conveyed as hereinbefore named by Littleberry T. Baughan to William Baughan and was by deed bearing date the (blank) day of (blank) conveyed by said William to said Joseph, the said William hereby acknowledging the payment of the sum of (blank) dollars in consideration of the excess of 3 acres 1 rood & 24 perches. The said Sally, William, Joseph and James F. Baughan and Sally Ford hereby convey all their right, title and interest to Benjamin Baughan, in and to the Lot No. 2 of said plot containing 28 acres, 1 rood & 24 perches. The said Sally, Joseph, William, Benjamin and James F. Baughan hereby convey to the said Sally Ford all their right, title and interest in and to the Lot No. 4A of said plot containing 17 acres, 2 roods & 31 perches and the Lot N. 4B, part of the land purchased by said Littleberry T. and Joseph Baughan from B. J. Duval and containing 10 acres, 2 roods & 33 perches. The said Sally, Joseph, Benjamin and William Baughan and Sally Ford hereby convey to the said James F. Baughan all their right, title and interest in and to the Lot No. 6 of said plot containing 25 acres, and the said Joseph, Benjamin, William and James F. Baughan and Sally Ford, hereby convey to the said Sally Baughan, in lieu of dower, a fee simple right to No. 5 of said plot containing 25 acres. Witness the following signatures and seals. DuVal, a justice of the peace in the said County do hereby certify that Sally Baughan, widow of Littleberry T., Joseph Baughan, Benjamin Baughan, William Baughan, James F. Baughan, Sally Ford, widow of Richard Ford, parties to the within deed, and hereto bearing date May 28th, 1856, personally appeared before me in my county & acknowledged the within writing to be their act and deed, and desire to certify the same to the Clerk of the County Court of Henrico that deed may be admitted to record. Witness my hand this 30st day of August 1856 Benj. J. Duval Thos. S. Dicken As to Benjamin … Henrico County State of Virginia to wit. We Thomas S Dicken and Benjamin J. Duval, justices for the County aforesaid in the State of Virginia, do hereby certify Charity A. Baughan, wife of Joseph Baughan, Sarah Baughan, widow of Baughan, Mary E. Baughan, wife of James F. Baughan, parties to the writing bearing date May 28th, 1856, and hereto annexed personally appeared before us in our County aforesaid and having been examined by us privily apart from their husbands, having the aforesaid writing fully explained to them, they, the said Charity A, Sarah and Mary E. Baughan acknowledged it to be their act and deed and declared they had willingly signed it and wished not to retract it. As Witness, our hands this 30th Day of August, 1856. Thos. S. Dicken Benj. J. The above plot represents a survey of land in Henrico County about nine miles above Richmond made for the legatees of Littleberry T. Baughan, also division of same by direction of said legatees as shewn on the face of the plot. The part shaded yellow being the land the said L. T. Baughan resided on before he made deeds for portions of it to his sons Joseph, Benjamin and William and that shaded pink, the land he purchased with his son Joseph from Benjamin J.
