I, James Atwood of St. Patrick’s Parish and Prince Edward County, sick and weak but of a good and sound memory. First, my just debts to be paid, and after that, if my wife Mary Atwood does not third the land then to my wife – during her widowhood and no longer, half the dwelling house I now live in, with 50 acres joining thereto, and one fifth of my (house) hold goods, and one fourth of my cattle, hogs, and sheep. Also 1 roan horse, and 5 L per year. If she thirds the land, then I don’t lend her anything. After her death or marriage, this legacy to my son Benjamin Atwood.
I charge my son James Atwood with the cash I lent to my wife.
Executors: my friend George Forrest and my son James Atwood. Signed July 2, 1771 – James Atwood. Wit: James Wad, Charles Wade, Josiah Cunningham.
At Prince Edward Court of October 21, 1771, the will of James Atwood deceased was presented in court and proved by James Wade, and at another court for Prince Edward November 18, 1771, this will was further proved by Charles Wade and or James Atwood Junior, one of the executors, refused in court to take execution of the will. John Ligh, Gentleman, was granted administration of the estate.

To all to whom these presents shall come greeting, know ye that I James Atwood Senior of the Parish of St. Patrick & County of Prince Edward for divers good causes & considerations me hereunto moving but more especially for and in consideration the natural love & affection which I have & doth bear unto my son Benjamin Atwood of the same Parish & county & for the consideration of five shillings current money to me in hand paid before the sealing & delivery of these presents, hath given granted sold and confirmed and by these presents doth give grant sell & confirm unto the said Benjamin Atwood and his heirs forever, 2 Negroes named Sall & Glorter the younger also one fifth part of all my household goods also one fourth part of all my cattle, Hogs & sheep in where hands custody possession or keeping so ever the same are or can or may be found to have & to hold all and singular the said Negroes goods & cattles & household whatsoever of me the said James Atwood Senior unto the said Benjamin Atwood his executors, and administrations or assigns from hence forth…. Election of vestrymen for both Raleigh and Nottoway Parishes followed the division of Raleigh, freeholders in the respective parishes voting in the elections. In Nottoway parish Charles Anderson, Charles Irby, John Nash, Joseph Morton, William Watson, James Atwood, George Walker, Richard Jones, Junior, Abraham Cocke, Henry Ward, Daniel Dejarnet, and William Baldwin were elected; they took the oath of vestrymen May 19, 1749 in Amelia Court. Of the vestrymen, Anderson, Nash, Morton, Atwood, Walker, Dejarnet, and probably Baldwin were residents of the western portion of the parish, which became Prince Edward.

The March, 1754, Court directed the sheriff to summon twenty-four “of the most capable freeholders” of Prince Edward to serve as a grand jury at the May Court. The first grand Jury consisted of James Atwood, Peter Davis, Samuel Southerland, Richard Childress, William Cambell, Henry Baker, Robert Elliot, James Thaxton, Philemon Holcomb, George Davis, Charles Ritchie, Michael McDearmon, Robert Galispie, James McMackin, and John Owing. Their one indictment was discharged.
