From Ruth Garrison; This Indenture, made and entered into this the second day of April one thousand eight hundred and forty six by and between Hezekiah P. Neil of the county of Scott and State of Virginia of the one part and second Samuel Ash and Andrew Ash and Thomas Ash and George Robinett for Mary Ash and Elizabeth and Lavina and Matilda, heirs of Daniel Ash deceased of Scott County and State of Virginia of the other part, witnesseth that for an in consideration of the sum of thirty five dollars to them in hand paid the receipt of which is hereby acknowledged hath this day bargained and sold and by these present both grant bargain and sell to the said H. P. Neil all our right title claim and interest that ever have to the estate land of Daniel Ash decd. lying and being in the County of Scott on the water of the North Fork of Clinch River and is bounded as followeth to wit Beginning at two hickory and a beech thence, N 65 E 110 poles cropping a branch thence thirty six poles to a chesnut oak and a dogwood thence 36 poles to a chesnut oak and dogwood on a Ridge thence S 25 W 120 poles to a spanish oak and hickory and a beech on the point of a ridge near a spring branch thence W 24 poles to a hickory and dogwood on a side of a hill ridge thence S 65 E 180 poles to the Beginning this tract of land is bounded on the North by W. Kinney estate land and on the South E. by H.P. Neil supposed to contain one hundred ____ acres be the same more or less to have and to hold the said tract or parcel of land with all its appurtenances there unto belonging or in every wise appertaining to the sole use and behalf of him the said H. P. Neil and his heirs forever and the said Samuel Ash and Andrew Ash and Thomas Ash and George Robinett for Mary Ash and Elizabeth and Lavina and Matilda heirs of said Estate for themselves and their heirs do covenant of and with the said Hezekiah P. Neil and his heirs that they and their heirs do covenant of and with the said Hezikah P. Neil and his heirs that they and their heirs will warrant and forever defend against all persons claiming in or through or by them in testimony where of we all subscribe our names and affix or our seal the day and year first above written. We the undersigned Archibald Fargy and W. H. Nickels Justice of the Peace in the County before said in the State of Virginia do hereby certify that Thomas Ash party to a certain ____ ____ sale on the 2 day of April 1846 and here to personally appeared before us in our County afore said and being personally and having the deed aforesaid fully explained he the said Thomas Ash acknowledged it to be his act ___ ___ land that he had willingly signed and delivered the same
