The Will of Thomas Apperson dated September 8, 1853

County of Yadkin, NC (formerly Surrey)

Know all men by these presents, that I, Thomas Apperson, being in bad health but of sound mind and memory, do make, ordain, constitute and appoint this to be my last will and testament in manner and form following:

It is my will that my body be decently interred at the discretion of my Executor hereinafter named, and for what worldly estate it has pleased God to help me with, I dispose of that in the manner as follows:

First, It is my will that all my just debts be paid.

Second, It is my will that my beloved wife, Luvitha Apperson, shall have the use of my tract of land which I now live on and all my negroes and stock of all kinds until the heirs shall all become of age; also, all of my household and kitchen furniture, with tools, etc., and all my property, after paying all just debts.

Third, When the heirs shall all have become of age, It is my will that my wife, Luvitha Apperson, shall have $100.00 and an equal share with the rest of the heirs.

Fourth, That all of the heirs which have not received a bed and a cow are to receive a common bed and a cow out of the estate and they draw an equal share.

Fifth, It is my will that all of my heirs not mentioned in this my last will, are to draw an equal share of the remainder of my property when it is divided, or sold, as the case may be.

Sixth, If my beloved wife, Luvitha Apperson, should marry before the heirs shall all have come of age, the division shall take place at the time of her mariage.

Seventh, I do appoint my son, William H. Apperson, and my wife, Luvitha Apperson, Executors of this my last will and testament, hereby revoking all wills by me formerly made.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed my seal this 8th day of September in the year of our Lord, Eighteen Hundred and Fifty Three

Note: Luvitha Apperson's maiden name was Vest. She was a daughter of Isham Vest & Nancy Pledge.
