Following is a copy of the court record, Steuben Co, NY, in which Josiah seeks a pension for his part in the Revolutionary War.
"On the 16th of Oct in the year 1832, personally appeared in open before the Court of Commo n Pleas being a Court of Record, now sitting at the Court House in Bath in and for the said c ounty, Josiah Sabin, a resident of the town of Bath in the said County of Steuben aged eighty five years last April who being first duly sworn according to law, doth, on this oath, mak e the following declaration in order to obtain the benefit of the Act of Congress passed Jun e 7th 1832.
"That he enlisted on or about the first day of November in the year 1775 at New Providence i n the state of MA, where he then resided, under Capt Reuben Hinman, Lts Low and Blakesly, Reg iment commanded by Col Seth Warner and Maj Jeremiah
Cady: remained at Providence until the first of Jan 1776. Commenced our march on that day t o Lake Champlain, at Crown Point, thence to St Johns down the lake on the ice; thence to Mont real where we remained about two weeks on account of the badness of the weather; thence to Th ree Rivers; thence to Quebec, where we remained until about the eighth of May 1776. While a t Quebec this declarant had the small pox. He inoculated himself, got the infection from th e hospital. He again inoculated many of the soldiers but as this was against orders, they wer e sent into his room blindfolded, were inoculated and sent out in the same condition. Many li ves were saved by this measure, as none of the inoculated died while three out of four who to ok it the natural way, died. "He was reproved by Gen Arnold, as he was suspected of inoculati ng, but his conduct was approved by his Colonel (Warner), and when he was taken before Gen Ar nold, Col Warner went with him; and after a considerable controversy and many sharp words bet ween Col Warner and Gen Arnold he was set at liberty without punishment. The following incide nt took place while at Quebec.
"This declarant being on guard, Gen Arnold who had been out 'woman hunting,' beyond the lin e of sentinals, late at night attempted to pass this declarant to come into quarters. This de clarant ordered him to stand, and to give the countersign. The latter he could not do, as h e left his quarters before the countersign was given out. He was compelled to remain in his s ituation until the guard was relieved. Gen Arnold afterwards complimented this declarant fo r his faithful performance of duty.
"Marched with the troops early in May 1776 about the 6th or 8th of the month, on their retrea t to the Soral River; thence up the Soral River to St Johns, at the Falls of the Soral abou t fifteen miles from Three Rivers point, the boats were drawn about three miles by land roun d the falls. From St Johns passed up the river and into Lake Champlain, crossed over into th e state of VT, thence to Providence, where we arrived some time in Jun 1776, and about the la st day of Jun same year was honorably discharged at Providence aforesaid, but said discharg e has been lost. He has no evidence documentary or otherwise of said
service.
"The declarant further states that early in Jun 1777 he again entered the service as a militi a man, at Dalton in the state of MA where he then resided under Capt Zebulon Norton. Don't re call the names of the other officers. This company marched to Bennington, arrived there jus t after the Battle at that place in 1777. Marched from thence to Fort Miller, thence to Fort Edward,
thence to Fort George; removed the munitions of War and blowed up the magazine. Before we ar rived at Fort George, an engagement took place between the Americans and the British at a pla ce according to his recollection Kingston Bridge, in which the British were driven. Thinks th at Gen Schuyler commanded, and remembers that an officer had a horse shot under him, but hi s name he does not recall.
"From Fort George retreated to Fort Edward, thence to Fort Miller, thence to Saratoga to go w ith the prisoners taken by Col Brown to Worcester. Went to Worcester with the prisoners, an d while on our return to Saratoga heard that Burgoyne was taken, and was honorably discharge d at Pittsfield, MA. While on our march toward Saratoga when we heard of the capture of Burgo yne, somewhere about the latter part of Oct 1777, having perfomed a tour of about five months . Said discharge has been lost, and he has no evidence documentary or otherwise to prove sai d service, nor does he know of any person by whose testimony he can prove his service.
"He was born in Plainfield, Windham Co, in the state of CT on the 15 Apr 1747. He has a recor d of his age in a frame with a glass over it. He has resided since the revolution at Stephens town, Columbia Co, NY state, afterwards at Bennington in the state of VT and afterwards in Otsego in the state of NY, then Cazenovia, NY and now at his present place of residence.

"The children of Josiah Sabin shown here correspond to a questionnaire submitted by Ara William Sabin, Josiah's grandson, to the LDS Church, in which he listed all of father's and mother' s siblings."

The following was submitted by Lynn Sabin :

"Josiah Sabin

"Attempt to prove that Josiah SABIN, supposedly born 15 April 1747 in Plainfiled, Connecticut, was the son of Israel SABIN and Avis BENNETT who married in Preston, Connecticut on 28 December 1748.

"Original records were searched in Plainfield.

"Vital Records: There were NO vital records for any SABIN's in the 1700's.

"Land Records: There were NO land records for any SABIN's, neither in the grantor, nor grantee indexes, through 1801.

"Probate Records:

"3:364A dated 10 February 1761. Inventory for Israel SABENS [sic]. Israel's inventory consisted of a cow, gun, pillows, blankets, a bed, and other household items. No land was listed in his inventory. Total value of the estate was around 15 pounds.

"4:196 dated 13 January 1761. Administration is granted to Avis SABIN of Plainfield on the estate of Isreail [sic] SABIN late of Plainfield deceased.

"4:258 dated 6 October 1761. Mr. Aves [sic] SABIN is appointed guardian for William SABIN, Aves SABIN, and ISREL SAVINS [sic] all minors. Mr. John GREEN Jr. is appointed guardian of Elizabeth SABIN and Nathaniel SABIN, minors.

"5:350 dated 4 February 1766. William SABIN, minor son to Isreal SABIN late of Plainfield, made the choice of Mr. Joseph FARNUM of Canterbury to be his guardian.

"Discussion: Since Israel SABIN supposedly died on 17 August 1761 the early 1761 dates found in the probate records were likely meant to read 1761/2. Perhaps the clerk did not copy over the double dating. All the other children of Israel and Avis are named in the guardianship papers, except Josiah. Was he not their son? Was he already serving as an apprentice elsewhere and did not need a guardian? Josiah was about age 14 when Israel died. William was age 12 when he requested a change of guardians in 1766. Who is Mr. Aves SABIN named as guardian in the guardianship records? If Josiah was in fact born in Plainfield, it appears there were only two adult SABIN men there at the time: Israel and Aves. Could Josiah be the son of Aves? [There were no probate records for this man other than the guardianship records above]. Where did the birth date and place for Josiah of 15 April 1747, Plainfield, originate? Might there be existent church records in the CT State Library? Might Josiah belong to the SABIN's of Pomfret?"

Note: Josiah's BIRTH: Rehoboth-VR 737. Married by the Rev John Greenwood. [From MF] Josiah m. Rehob oth 18 Nov 1724 MARY GAY as appears in marriage and intentions records. In the Attleboro birt h record of son Israel she is called 'Mary Guy.' She has not yet been identified. Although Jo siah's marriage and his children's births and bapt. are recorded at Rehoboth and Attleboro, t here are no land or probate records for him in Bristol Co. An Israel Sabin was warned out o f Rehoboth 1 Apr 1745, "not being an inhabitant." Perhaps this was Josiah's 15-year old son I srael, the only child of the family not born in Rehoboth. Sons Israel & Nathaniel appeared so on afterward at Plainfield CT; Israel married at Preston CT 28 Dec 1748, Avis Bennett, and o n 19 Dec 1752, Nathaniel Sabin, "s/o Mr _____ Sabin, late of Rehoboth, dec'd," appeared at co urt in Plainfield CT and made choice of Mr David Downing as guardian. Nathaniel being then ag ed 14, the guardianship probably indicates that the boy was being apprenticed, but was not he ir to an estate. The guardian David Downing was the friend named in the 1759 will of Ebeneze r Welch of Plainfield, Josiah Sabin's cousin. When and where Josiah Sabin and his wife Mary d ied, or what became of their other children is as yet unknown. It is reasonable to assume tha t Josiah died before 28 Dec 1752 in view of guardianship above. Some have suggested that thi s man's name was Joseph instead of Josiah.

It is probable that he died soon afterwards, for his children scattered at an early age. N o probate record in Bristol County has been discovered.

Note:
William Sabin, the miller of Rehoboth, MA, is the immigrant ancestor and progenitor of the S abin family in America and Canada. He is often referred to as the patriarch of the family si nce he married twice and fathered twenty children.
In the three hundred and fifty years that have passed since the first record of William Sabin in MA some 10,000 Sabin descendants have populated the United States.
William Sabin was born in Titchfield, Hampshire, England. His baptism is recorded in St. Peter's Parish, Titchfield, England: 'Oct 1609 bapt. William Sabin, the XI daye.' The parent s of William Sabin are not listed in the baptismal record as was the custom of the time. It is believed that William was the son of Richard Sabin and Mary (Bushe) Sabin who were married 29 October 1608. Richard was buried 1 June 1641 and Mary was buried 14 October 1644 (Extra cts from the Parish Register of St. Peter, Titchfield).
The IGI has William Sabin as the son of Samuel and Elizabeth Sabin bc 1615, Titchfield, Hamp shire, England. Lillian Swihart, a subscriber to the Sabin/Sabine/Sabean Genealogical Newsle tter offers the point of view that this information might be correct since the first two children of William were named Samuel and Elizabeth and that William failed to name any of his ch ildren Richard which was the name of both his father and father-in-law (SFN: Vol. IX, no. 4).
From the family of a later Sabine immigrant we read: "The Sabine family can be traced back as far as 1600 AD. The first we find of them is in the County of Hampshire (Hants) England, at Titchfield and towns near thereto. They were Puritans and Nonconformists of early date and glorious memory." (Sabine, John Dickinson. The Family and Descendants of Rev. James Sabine . Washington, DC, 1904. John Sabine was an immigrant from England to America in the early 17 00s and not a descendant of William Sabin.)
William Sabin arrived in America sometime before 1642 when he is first recorded in conjuncti on with the organization of Rehoboth, MA. It has not been determined how William Sabin got t o America. One suggestion is that he may have come on the ship Brevis when a group of Titchf ield people sailed for New England from Southampton in May 1638. This fact is yet to be prov en [SFN: Vol. II, no. 3, page 7].
It would appear that William Sabin arrived in America with his wife Mary Wright (According t o the IGI, a Mary Wright was born about 1620 in Kirk, Deighton, North Riding Yorkshire to Ric hard Wright). William and Mary were married about 1639. That their first two children, Samuel and Elizabeth were born in England is speculative and needs to be proven.
Rehoboth (The Roomy Place) is located near Swansea, MA. Here was established th e first free public school system in America in 1643 with the Massachusetts Bay Colony follow ing suit four years later. William took up land in the area, now located in Rhode Island, kn ow as Seekonk.
William Sabin was one of the leading citizens of Rehoboth participating in matters of schools, church, and affairs of the Plymouth Colony. That he was a man of considerable culture an d possessing wealth is shown in the account of his estate and gifts for the relief of the wan ts of those who suffered the ravages of the Indians.
