British Soldier Remaining in America after War

What would have been the procedure for a British soldier or sailor to remain in America following the Revolutionary War? Would he have been required to take an oath? Someone I know is researching one James Jaynes, who supposed served 7 years in the British navy during the War and then became "a citizen of Virginia".

Thenks for any enlightenment on this subject.
