SUMMERS FAMILY IN ALABAMA. MOSES SUMMERS, b. abt 1806, VA, d. abt 1851, Fayette Co., AL. Married on Oct. 24, 1823 in Morgan Co., AL to MARY LVINGSTON, b. TN. Their children were: FRANCES E..; R.M., ARTY A.., b. abt 1831, AL, d. abt 1899, Lamar Co., AL, mar. on May 1, 1856 in Fayette Co., to JALA A. LINDSEY; WILLIAM T., b. abt 1833; ESQUIRE C. (CLARK?), b. abt 1840, mar. on Dec. 16, 1860 in Morgan Co., to Mahaley E. Bennett; MARY "POLLY" C., b. abt 1842, married D.C.SLATER(residing abt 1870 in Henderson Co., TN); C. DANIEL P., b. abt 1844; SCYTHIA F., b. abt 1846, married to JAMES C. RICHARDSON(residing in Carroll Co., MS abt 1870). MOSES appears on the 1840 and 1850 Fayette Co., AL censuses. In 1850 Calvin Guin, age 28, appears to be residing with the family. Moses' age is listed as 44, Mary's as 35. It is believed that Moses was either a Sheriff or jailer in Fayette Co., abt. 1849. In March 1849, Arty A. Summers was appointed guardian for C. Daniel, R. M., and Frances E. Summers, minor heirs of Moses Summers. In May 1857 Arty A. Summers was appt'd adm. of the estate.
The probate papers in Fayette Co. give names of children, some grandchildren. It is believed that ESQUIRE C. SUMMERS fought in the Civil War, and perhaps died. There is record of a SQUIRE CLARK SUMMERS, Confed. Inf. 41st Reg. Ala. Inf. However, he and Mahaley had a child: Mary F. Summers. In the probate papers (Dec. 1870) it is stated that Mary F. Summers, minor grandchild of the deceased (Moses) resides with mother and step-father Andrew Williams in Morgan Co., she's abt. 10 years old. MAHALEY (BENNETT) SUMMERS remarried Andrew Williams in Nov. 1866.
Arty A. Summers and Jala had the following children: Mary A. (Aggie), b. May 1856, mar. on Nov. 12, 1870, Lamar Co., to Alexander A. Wall; Donzilla (Donnie), b. Aug. 4, 1859, d. Oct. 29, 1900, mar. on Mar. 11, 1880, in Lamar Co., to Green Evans Bankhead; Idella S., b. 1860, mar. on May 17, 1877 to B. (Birt) L. Hill; William, b. Oct. 1866, mar. to Berta ?; David, b. July 1869; Issa (Icie), b. Mar. 1877; and Minnie Helen, b. Jan. 1878, mar. on April 25, 1895, Lamar Co., to Walter Nesmith. All of these children and/or spouses are named in the probate records of Arty and Jala, Lamar Co., AL.
On the 1900 census, Lamar Co., Jala is shown as head of household, with son Willie, b. Oct. 1866, age 33, Willie's wife Berta, age 23, and their child Arwill(Atwill?) J., b. Mch 1900; and Jala's dau. Icie, b. Mch 1877.
To confuse researchers, in the probate records of Mary Livingston (1870s), mother of Mary (Livingston) Summers and Aaron Livingston, brother of Mary (Livingston) Summers, there is mention of an heir "Mary Bennett" residing in Fayette Co., AL, mar. to Jesse Bennett. On the 1860 Morgan Co. census, there is a Jesse Bennett, age 59, with wife Mary, age 48, dau. Mahaley Bennett, AGE 18, (who married ESQUIRE C. SUMMERS), Lula A. Bennett, age 12, and Tandy Summers, age 18, Patten Summers, age 16, and Cyntha Summers, age 14. It is believed that Cyntha Summers is the dau. of Mary and Moses who married James C. Richardson. Tandy(?) and Patten are shown as students. If this MARY BENNETT is the same as MARY SUMMERS, she shows up on the 1870 Fayette Co. Census as M. SUMMERS, age 69, female, b. TN. And when her brother MOSES LIVINGSTON wrote the probate judge in Morgan Co. in 1881 regarding their brother Aaron's estate, he says that he and his sister Mary Summers are the only living heirs...meaning brother and sister of Aaron.
The 1860 Fayette Co. census shows a William Summers, age 25, with wife Missinea (?), age 22, daus. Almeda, age 4, and Mary, age 2, and residing with them was Jesse Hays, age 78, b. VA.
For those researching the Moses Summers probate files, there seems to be confusion between a Moses Perkins with wife Mary Summers, and my Moses Summers and wife Mary. They all lived near each other, were about the same ages, etc. I have not had time to sort out all of this, but researchers should be aware of it.
I am researching Moses Livingston, his ancestors, descendants, and all collateral lines. Any information on any of the above would be greatly appreciated. Pat Dakin
