William Ackles testimon in John's will

William Ackles, who being duly sworn deposes and states as follows, I am 68 years old. I can't say that I am not interested, I have an unsettled account with the estate, that is all the interest I have. I am a brother of the deceased John Ackles. About 4 weeks before he died I went to house and he seemed to be much pleased that I went to see him, said he had made his will and willed Mr Seely and wife 50 acres of land, meaning the old homestead where he lived, that he had willed his brother Bryant 10 acres and 10 acres to his son Tartulus Ackles, then laid down and talked no more about his will, that is all I know about it. I don't recollect that he spoke about altering his will. I went to see him again about a fortnight afterwards and he said he wanted to have the old lady as comfortable as he could, this is all he said. I was at his house 3 or 4 days during his sickness in January 1844. Said nothing about making his will. 3 or 4 years ago he stated to me that he meant to give Mrs Seely 50 acres of land and that was all he meant to give her.
