Testimony of James Ackles

James Ackles, being called & sworn in the same behalf testifies as follows, I know John Ackles, deceased of Tully for 20 years, he was my grandfather. I am a son of Frederick Ackles. I attended the deceased through part of his sickness in January 1844. I was there part of one day that his will was drawn. I went there ? January and was there 10 or 12 days most every day, don’t know but twice a day. I was there I think the 2nd day. I asked him that morning or the morning but one before how he felt. He said "Oh dear James, I don’t know it seems to me that I am away from home". I said Grandfather you are at home. It seemed to him he was not - I think he was not capable of making a will. I went into the room where my grandfather was after seeing Mr. Vail. I don’t know as I had any conversation with him except to ask how he felt, don’t know whether the conversation above detailed took place that morning or the morning but one before. I give my opinion from my observation that morning & during his sickness. Can’t tell whether he had rallied any that morning. Did not see him at any time where I thought him capable of doing business during the 10 or 12 days I was there during his sickness.

Cross Examination (X) On his cross examination this witness says; The old man would speak out when he thought no one was in the room and use profane language & to himself he was commonly addicted to profane language. I think that is an evidence of insanity, speaking to himself, & swearing at himself - Nothing more to show him incapable except what he said about not being at home, and talking and swearing to himself.
