Can anyone help us in obtaining a copy of the full probate pkt for the estate of Joseph Rutherford who died 19 DEC 1797 and had his will proven in JAN 1798 in Edgefield Co., SC? John A. Chapman included some biographical material in History of Edgefield County about one of his contemporaries named Joseph Abney, son of John Abney and Agatha Griffith. Chapman does not report his middle name, but his mother's maiden name would be a plausible choice, and some people have indeed reported it that way. He was born 2 Dec 1819, married Susan Miller in 1858, was wounded in the Civil War, died after 1 Aug 1866, when the Edgefield Advertiser reported his return to Edgefield with a wound that was "very severe" but "not dangerous". I don't know what that might mean. This Joseph Griffith(?) Abney could not possibly have married Dorothy Rutherford, given that he was two generations her junior, besides being married to somebody else. The 1810 will of Joseph Griffith states that one of his daughters married Michael Rutherford. Joseph Griffith had a daughter Agatha, probably the woman who married John Abney later (and had son Joseph in 1819), since Agatha Abney witnessed an 1820 sale from Joseph Griffith (Jr.) to Joseph Rutherford before JQ John Abney. At any rate, the Rutherfords, Griffiths and Abneys interacted and intermarried, which might help to explain how Joseph Griffith Abney got married-off (per the DAR application) to an older woman.
